Upon inspection of the well head the following was found- 8.625 surface casing-4.5 production casing and 1.5 production tubing with the well set up to be produced through the 1.5 tubing as a swab well. At the production fluid storage area a single 100 barrel production tank is present along with a mechanical separator and gas sales meter with no current sales chart in the meter and no earthen dike present. The last reported production was in 2013 and the condition of the well and tank battery supports the lack of presence from the well owner in an extended period of time. Addressing the Pre-Exempt transfer - The well was found idle and incapable of production with no domestic hook up present at the well or tank battery. I explained to the landowner that the well was in violation and idle both commercially and domestically and the registered owner with the Division had not reported production since 2013. The landowner knowingly admitted He was not using the well for Domestic house gas and the residence was at least 1 mile from the well. The legal council for the landowner identified as a Chris Justice with a Firm known as Tyson and Brock has also called and indicated His client Mr. Ritchie has been awarded the lease and well in the local court. I explained to Mr. Justice also that the well is idle and in disrepair and we would not transfer the well in its current condition in order to avoid the well becoming a liability to the landowner and possibly the State. The due process of the law the Division Regulates should be followed and recognized at all times. MR. Justice was provided with the Divisions Legal staffs contact information and advised to take up any further questioning or conversation with them. |

The well ownership was attempted to be transferred over to the landowner a one Virgil Ritchie. Mr. Ritchie along with the Attorneys representing both the landowner and producer have notified me indicating the producer has lost His lease and the court awarded Mr. Ritchie ownership of the well. All parties have been informed that the well is idle commercially with no reported production since 2012 and there is no domestic hook up from the well to the Ritchie residence. I will also note that the landowner was being provided gas from a commercial transportation line that served multiple wells in the area owned by the producer. Kerry Brown who represents the company has been notified by both mail and phone that the well must be brought into compliance and capable of supplying gas to the residence before the Division will transfer it over to the landowner as a domestic well. |

On this day I was contacted by the landowner Virgil Ritchie in regards to the incomplete well transfer. I explained to Mr. Ritchie that under my understanding the initial transfer request was not processed due to the well not being capable of domestic or commercial production. I in return contacted the Divisions Surety & Bonding Supervisor Jon Austin and followed up on the well transfer and updated Mr. Austin with the following information as described. During past conversations with the landowner and legal council for both the landowner and well owner it was explained to me with the understanding that the lease assignment between the landowner and KA Brown has been voided through the court system and the lease along with and including physical property described as the well and production equipment have been awarded to the landowner Virgil Ritchie. I also explained to Mr. Ritchie on this day that if indeed the well was transferred into his name, upon becoming the responsible party any compliance issues with the said well noted by the Division would be his responsibility to resolve. The said well was transferred to the landowner on this day. |
