0038322312 2007-09-18 Administrative Inspection No Violations Called Bakerwell office and Rexs Cell phone. I left messages on both systems. I told Rex that he needs to contact me Re: lack of vegetative growth, Failure to restore site.
0270688560 2007-04-17 Drill / Deepen / Reopen No Violations Prelim Rest is over due. Site is not done. There is a slip on the east side of the site. Surface water needs to be diverted away from site. Run off is causing a wet area 50 by 100 North east of the well. Bare ground 10 by 100 South west of the well. Tank dike has a French drain with no valve to close the drain pipe off. Drain pipe is 3 PVC and it discharges in to a shallow area south east of the well parallel to the gravel lease road. Orange safety fence is still around the site it is on the ground . Fence posts are still surrounding the north east hill side. There are sections of steel pipe laying on the east side of site. The gates on the well and tank dike fence are not secure both gates can be opened with out un locking the gate. Surface run off is causing erosion on the west side of the site. Pipe line right of way is bare and needs to be regraded and seeded and mulched. I talked to Rex Baker at the #651 site and he told me that they are going to plug back the well and remove the tank at that time. They are aware that the site needs work and are planning to fix the site after the plug back.

0809807830 2008-08-13 Production Wells No Violations This is an urban site. No identification is posted. No work has been done to fix the small slip above dike. Well is not in production. Well is not connected to lines. Fencing around wellhead is not secure the posts are not attached to the ground. The posts are inside a larger diameter pipe that is in the ground. The gate is not locked. Pipe and fencing is being stored on location and not being used. This is in violation of 1501:9-9-05(E)(5)(b).
1182780199 2007-06-21 Plug / Plug Back No Violations Rex Baker plugged back to the shale. He is going to try to produce it without drilling horizontally. He will drill horizontally if this does not work. Universal Well Service had a problem with the water that Baker wanted them to use. The water was from the steel tank on site and had some brine in it. This caused the cement with 4% Cl to flash in the hose and set up. This caused a delay while Universal cleared their lines . None of this flashed cement went into the well. The Clinton was plugged with a 200 plug from 3392 to 3192 and the Big Lime plug was plugged with a 240 plug from 2803 to 2563.
1190296039 Preliminary Restoration No Violations Preliminary Restoration is over due. Site is not done. There is a slip on the east side of the site. Both gates can be opened without unlocking the gate lock. Surface run off is causing erosion on the west side of the site.
1203652275 2007-09-18 Preliminary Restoration No Violations Slip has not been fixed. Gates to well and equipment are not secure. Both locks can be defeated with ease. A very small chain with a clip on one end was on the wells gate. This clip defeated the lock because the lock went through the clip which can be easily opened. The hillside is still eroding. Sediment is pooling at the wellhead. Site still has bare un vegetated areas. Debris still on site like: Tarps, Plastic pipe, Safety fence. Children live next door and evidence such as toys on site suggest that children play at the well site and on the equipment.

1408403568 2008-06-09 Production Wells No Violations This is an urban site. Since the plug back on 6-21-07 the well has not been in production. No identification is posted at the well. It needs an urban id. The hill is still slipping. Most of the production equipment has been removed. There are sections of fencing and pipe still located in the tank dike area. The slip needs fixed and vegetative cover needs to be established. I have called Rex Baker and left him a voice mail about the violations and the need to fix the slip and get vegetation growing.
1409251931 2007-08-09 Production Wells No Violations No work has been done to the well site since the plug back. The hillside is still slipping and the tank and equipment are still on the hill side within the fenced in dike area. Both gates are easily compromised due to the poor construction of the fencing. I have talked with Rex Baker about this and I told him to use a piece of chain to lock the gates so that the gate lock cannot be spread apart and the lock defeated. Site still needs more vegetative cover established. Id is good. Well is capable of production all lines are connected to the well.
1442170594 2007-07-23 Production Wells No Violations Nothing has been done to the site since the plug back. Fencing is up at the well head and the tank dike. The tank is still on site in the dike. The hillside is still slipping and the gates are not chained off like Rex Baker and I talked about. The Locks on the gates can be easily defeated due to the poor fence construction that allows the poles to be moved in such a way that the lock is not in contact with the pole allowing access to the well and tank.
1642551770 2008-02-28 Production Wells Violations Noted Tank and equipment have been removed. The tank is not needed since the plug back. The well is not connected to a line. No id on site. The hillside slip needs to be fixed. I have talked with Perry Brock and he is going to fix the slip and get grass growing this spring. It is too wet for this work to be done now. Orange safety fence and green steel posts are still located on the hill side. They need to be removed. Also fencing parts from the tank battery need to be removed along with old fittings and pipe that are on location. This is an Urban Site. I have called Rex Baker and he said that he is unaware of the urban id requirements. I informed him of the requirements of 1501:9-9-05(E)(1).

1993475646 2007-09-24 Administrative Inspection No Violations 9:00 am Called Bakerwells office and talked to Rex Baker Re: NOVs and Preliminary Restorations that are past due. Rex said that he never plants grass in pasture fields and did not think that the State had rules to that effect. I informed Rex of his obligations to establish vegetation on all well restoration sites. Rex then informed me that he lost his contractor in the area and is having a hard time finding someone to do the work (plant grass). I discussed my concerns about not mulching the site. I explained how the mulch not only helps to get the grass to grow mulch also helps hold loose soil in place to prevent erosion. Rex said that he will see what he can do in the next few weeks. I called Joe Hoerst and explained my conversation with Rex and Joe agreed to give him two weeks to get some grass growing before we go to the next level of enforcement. I also discussed the slip on this site with Rex he did not feel that the slip was a concern. I informed him that the slip needs to be fixed before the preliminary restoration can be passed. I asked when the tank and other equipment were going to be removed from the site. I had been told that the equipment would be removed after the plug back. Nothing has been done. The equipment being on site is the excuse for not finishing the restoration. Removing the equipment will tear up the site. We also discussed the fencing issues that I have and the fact that they are not in compliance with the urban rules.
