There was new gravel and straw inside of the dike. The oil had all been cleaned off the front of the tank and the valve. I spot checked the area around the tank with a shovel, and found some residual oil in the gravel, but it was sparse and thin. I called Jerry Butcher, the son-in-law of Joe Chaney, who has been handling the clean-up. Jerry said that they had a truck load of soil that they were waiting to deliver to Tunnel Hill landfill. He said that he was waiting on the manifest paperwork to clear and he would send me a copy when he gets it. I told Jerry that he has three more things to do to completely resolve the compliance notice. He has to get the manifest to me, he has to have the plastic tanks drained and removed from the site, and he has to establish vegetative growth outside of the dike. |

I found 1.5 line running from the well head to a regulator into many layers of insulating blankets and tarps secured with pallets. I did observe 2 black plastic line running from the bundle of insulation into the ground in the direction of a residence at #3731 TR 68A. The tank battery consisted of two 100 barrel tanks that were heavily rusted and not diked. Identification was posted. I found an un-lined earthen pit in front of the storage tanks that was full of water and oily sludge. There was a valve on the bottom of one of the 100 barrel tanks that opened to a plastic line that led to the earthen pit. I found multiple points around the pit where fluid had leached through the pit walls. I tested the fluid with a high range Quantab and found that the fluid contained 2538 ppm (parts per million) chlorides. The pit lies uphill from an intermittent stream which feeds into the Little Wakatomika Creek. The pit must be drained and the fluids disposed of at an approved injection well. All contaminated soil must be removed from the site and disposed of at an approved landfill. An earthen dike must be constructed around the storage tanks. |

I stopped to investigate and found that there were two 100-barrel steel tanks that were set on blocks and both tanks were empty. The front of one of the tanks was covered with crude oil from the top to the bottom. The load line valve and base of the tank was covered with a thick oily residue. Straw had been spread throughout the earthen dike and around the bottom of the tank. The straw around the tank was saturated with crude oil. There was crude oil soaked into the soil under the tank that had been run over. There were some other areas in the dike where crude oil had soaked up through the straw. The dike was set in an elevated position approximately 20 feet south of TR 68-A. The ground surface was bare of vegetation from the base of the dike to the road and it was also covered with straw. The bare area was approximately 40 feet wide, parallel with the road. I did not find any crude oil in the soil or straw outside of the dike. There were some small pockets of standing water in the bare area, so I tested for chlorides with a low range Quantab strip. The low range maxed out immediately so I tested with a high range Quantab strip. The high range strip also maxed out at 10 Quantab units. The highest level on the scale was 8.8 Quantab units, which indicated the chloride level was above 6907 ppm(mg/L) or 1.139% NaCl. I also found some water in a tire track along the side of TR 68-A directly north of the dike, and I tested that with a high range Quantab strip. The titration showed 7.8 Quantab units, which equals 3700 ppm(mg/L) or 0.610% NaCl. I walked the roadside west and downhill until I reached the point where the roadside drainage ditch enters a culvert and the flow heads northeast in an intermittent stream toward Little Wakatomika Creek. I did not find any signs of oil in the roadside ditch or the intermittent stream, and I did not find any signs |

I called the number that was listed in the database and on the ID sign, and I spoke with Mrs. Gertrude Chaney. I asked he about the compliance notice that was sent out on 5/23/18 in regards to t he condition of the production equipment for their wells. She informed me that Mr. Chaney passed away a couple years ago and her son-in-law has been getting all of their mail. I asked who takes care of the wells and she said that one of their neighbors makes sure that they have gas to heat their home in the winter. I got the son-in-laws phone number and name, Dr. Jerry Butcher. I called him and explained what was needed. Dr. Butcher claimed that he only received the compliance notice yesterday and he has been in touch with a neighbor to do the excavating. Through the course of our conversation I concluded that Mr. Chaney had been draining the brine into the dike over the years and draining it into a plastic tank down by the road. Dr. Butcher admitted that he had been doing the same thing as his father-in-law because he didnt know any better. I explained the process of having the brine hauled and disposed of at an approved disposal well, and I made it very clear that what they have been doing is illegal and poses an environmental risk to the fresh water. He said that they will get started as soon as possible and asked if I could work with them on the 5 day remedy time. |
