I followed up on the incident and have filed a detailed report. All equipment on site looked good.

2551514 Primary Facility 2016-12-22 Incident- Response to Accident or Event In Compliance with Policy Inspection performed in response to Operator’s report of a 6bbl. “spill of diesel/oil base mud onto the primary containment at the well pad” on 12/21/2016 @ 1900 hrs. Operator informed Department that spill occurred due to the over flow of the diesel/oil base mud tank caused by the back flow of the shaker contents into the tank when worker opened shaker valves while forgetting to shut off valve into (diesel/oil base) mud tank. Operator calculated the release volume based on the recovery of the diesel/oil base mud from clean-up operations.

At the time of inspection, on-site representative stated that release occurred on to secondary containment and clean-up had been completed. Although spill does not appear to have impacted the ground at this time, but Department unable to adequately determine if the structural integrity of secondary containment has been compromised due to the presence of drilling equipment. 2594492 Primary Facility 2017-04-28 Routine/Complete Inspection No Violations Noted Apex setting up for frac of H-8 well. Wireline was completed. Sand was being delivered and injection pumps were set on 4/27/17. Apex looking to start on 4/29/17.

The secondary containment appears structurally sound. Four tanks installed on matting boards located on right side of well pad. Two rolloff boxes for residual waste located on site. Well head surrounded by cement barriers. According to Department records well was frac'ed in April 2017 and appears equipped for production. Contractors actively working near brine tanks.

At the time of inspection Department observed the additional secondary containment structures around the the two fuel tanks onsite filled with rain water. The two fuel tanks are located directly north and west of pad. Department recommends Operator empty the containment. No E&S issues.
