2463611 Primary Facility 2016-03-09 Preoperation Inspection No Violations Noted On 3/9/16, I performed a pre-operation inspection at the Baby Bear site in response to an operator request for a pre-op and made the following observations:

•Stacked CFS near coordinates N40°08’42.37” W80°01’27.94” was improperly constructed with all ends butting together at the same location. This is a violation of 25 Pa. Code § 102.11(a)(1), 25 Pa. Code § 78.53, 25 Pa. Code § 102.5(m)(4). •Multiple pad and access road drains were extended and modified directing flow into a non-permitted constructed rock lined channel leading to the northern wet pond. The operator requested red line change approval at the time of inspection. This is a violation of 25 Pa. Code § 102.5(m)(4) conditions 6e, 6f, & 16a. •The operator constructed unlined temporary channels diverting and moving water from one section of CFS to another in two separate locations below the western side of the pad. This is a violation of 25 Pa. Code § 102.11(a)(1), 25 Pa. Code § 78.53, and 25 Pa. Code§ 102.5(m)(4) conditions 6e, 6f, 8e, & 16a. -

Moved onto this well on 4/15/16 and resumed drilling at 40 ft. The 20” casing was set at 250 ft. on 4/15/16 and cemented to surface with 15 bbls returned. The 13 3/8” casing was set at 393 ft. on 4/17/16 and grouted to surface above the basket. Coal was found from 342 ft. to 353 ft. A basket was set at 317 ft. Currently at 2149 ft. and running 9 5/8” casing.

The 9 5/8” casing was set at 2134 ft. on 4/19/16 and cemented to surface with 22 bbls returned. TD was at 6960 ft. on 4/23/16.

2495158 Primary Facility 2016-03-11 Follow-up Inspection No Violations Noted On 3/11/16, I performed a follow up inspection at the Baby Bear site with regards to issues noted in the 3/9/16 inspection (eFACTS ID: 2463605) and made the following observations:

•Issues with improperly implemented CFS barriers were corrected. •Collapsed and damaged containment on chemical containers near the site entrance were corrected. •The rock lined channel system connecting pad and access road drains had not been remediated at the time of inspection. Outstanding violation, no new violation. •An auger was present on site and being used to dig cellars at the time of inspection.

Moved onto this well on 6/25/16 and resumed drilling at 6972 ft. KB. KOP was at 7465 ft. EOB on the curve was at 8558 ft. MD (7535 ft. TVD). Currently at 14,765 ft. MD and drilling ahead.

2499159 Primary Facility 2016-07-06 Drilling/Alteration No Violations Noted Patterson-UTI Drilling Rig #349

TD was at 18,855 ft. MD (7638 ft. TVD) on 6/30/16. The 5 ½” casing was set at 18,845 ft. Operator attempted to cement casing to surface. All barrels of spacer returned to surface. Estimated TOC is 0 ft.

2501971 Primary Facility 2016-03-17 Follow-up Inspection No Violations Noted On 3/17/16, I performed a follow up inspection at the Baby Bear site in response to an NOV from 3/9/16 (eFACTS ID: 2463605) and made the following observations:

•The rock lined channel system connecting the pad and access road drains had not been remediated at the time of inspection. Outstanding violation, no new violation. •An area where the CFS appeared to be separating was found near coordinates N40°08’42.276; W80°01’27.74” (near the site entrance along the access road). •Water was observed to be pooling in a depression where the site CFS is nearest the road north-west of the site entrance. •The cut slope on the back of the site was noted to have a nearly vertical grade contrasting with site plans. This slope was also noted to be unstabilized. No violation. Remediation recommended.

2502836 Primary Facility 2006-03-31 Follow-up Inspection No Violations Noted On 3/31/16, I performed a follow-up inspection at the Baby Bear site in response to concerns voiced by DEP Oil & Gas inspector John Rushin and an NOV from 3/9/16 (eFACTS ID: 2463605) and made the following observations:

2537234 Primary Facility 2016-10-26 Complaint Inspection No Violations Noted On 10/26/16, I performed a complaint response inspection related to the Baby Bear well site in response to complaint ID 323280 and collected samples for 0946 analysis.
2540983 Primary Facility 2016-07-21 Follow-up Inspection No Violations Noted On 7/21/16, I performed a follow up inspection at the Baby Bear site accompanied by Rice’s Jonathon Davis in response to ongoing situations at the site noted in multiple prior inspections and made the following observations:

•The high wall east of the pad remained at the time of inspection. The operator reported that the sheer cut resulted from issues with unforeseen bedrock outcropping as well as issues with utility line placements after the site surveying was conducted. A major modification to the site plans was submitted per the operator on 11/11/16. No violation. •Additional safety fencing was requested around the vertical portion of the high wall east of the pad to reduce the safety hazard. No violation. •The crease in the hillside below the southern end of the pad between the cut slope of the pad and the access road slope had a significant erosion channel forming due to large amounts of water being produced from pad and keyway drains in the area. 2541008 Primary Facility 2016-07-29 Follow-up Inspection No Violations Noted On 7/29/16, I performed a follow up inspection for the Baby Bear Site accompanied by Rice’s Michael Gatskie and Carey Bell in response to an operator request to review potential minor modifications and made the following observations:

•A request to implement a change of gradient in the area between the southern end of the pad and the access road to better reflect the permitted land contour as well as implementing a series of check dams to encourage sheet flow and prevent erosion damage from excess water in accordance with the sites permits was approved as a minor modification and added to site plans as a red line change. •An additional minor modification to the course of the pipeline’s path to reduce disturbance with no change to site contours within the well site LOD was approved and marked on site plans as a red line change.

2569206 Primary Facility 2016-11-17 Administrative/File Review No Violations Noted On 11/17/16, I performed an administrative inspection related to the Baby Bear well site in response to complain ID: 323280 and made the following observations:

•WQS Supervisor John Carson and I reviewed the laboratory results for the samples taken 10/26/16 as well as other situational information and found that water chemistry parameters while high in multiple parameters do not conclusively indicate oil and gas impact.

2620373 Primary Facility 2017-07-05 Incident- Response to Accident or Event No Violations Noted On 7/5/17 an INCDT inspection was conducted of the Baby Bear pad in response to a spill reported by the operator (CTS ID: 327676).

>>A truck was found to be leaking fluid to the pad. No containment had been placed under the leaking equipment. This constitutes a violation of 58 Pa. C.S. 3218.2(d), 25 Pa. Code 78.54, and 25 Pa. Code 78.57(a) in that the operator failed to contain fluids associated with the servicing of wells and use appropriate secondary containment.

>>The operator reported that roughly 20 gallons of production fluids had been spilled to the pad during servicing. Cleanup of the spill was completed at the time of inspection. One roll off box of contaminated material was removed from the site and conductivity testing was performed to confirm complete removal. This constitutes a violation of 25 Pa. Code 78.54 and 25 Pa. Code 78.57(a) in that the operator failed to contain production fluids, these violations are regarded as immediately corrected.

2730898 Primary Facility 2018-05-16 Routine/Partial Inspection No Violations Noted On 5/16/18 a routine partial inspection of the Baby Bear well site was conducted in response for an operator request for review of a minor modification to the site. The following was observed:

>>A landowner requested site modification to allow access to a field for agricultural use. The operator requested approval for a modification consisting of adding an access road shortly before the pad using pipe and rock fill to bridge the roadside culvert at its high point and allow access to the field up gradient of the primary site access road.

>>The modification was noted in site plans and approved at the time of inspection. Construction is expected to be completed the following week.

2746520 Primary Facility 2018-05-16 Routine/Partial Inspection No Violations Noted On 5/16/18 a routine partial inspection of the Baby Bear well site was conducted in response for an operator request for review of a minor modification to the site. The following was observed:
