2637084 Primary Facility 2017-09-13 Routine/Complete Inspection Violation(s) Noted At time of inspection the waste disposal well appears plugged. Erected monument installed with Operator name, well name, API, and date plugged (8-2-17) placed on monument.

Five brine tanks located on site. Six barrels and 5 buckets located near brine tanks. Brine tanks and barrels/buckets do not appear to be in secondary containment (photo 1). During the plugging of this well, H2S gas was reportedly detected. Altair 5X and Bascom Turner units were utilized during this inspection. Department observed areas of standing fluid on well pad (see photo #2, 2A and 2B). Well cellar (approximately 10'X10'X4') being overtopped by fluid (see photo #3) at this time (9:00). Oily sheen was observed on the fluid in the cellar and on the fluid on the well pad. Four pieces of lumber (approximately 8' long) floating in cellar. Bubbles are observed rising intermittently through fluid in cellar on NW side of monument. Oakton pen field readings taken at 9:35 of the fluid in the cellar: pH 8.38, conductivity 2330 mS/cm, salinity 1

2637994 Primary Facility 2017-09-20 Plugging(Includes Plugged/Mined Through) No Violations Noted Arrived onsite at 11:30 am. WQS personnel Symathana Folk and Cynthia Witham were onsite. They were preparing equipment for site inspection at the vehicle parking area. DEP Informed Bill Decshare from MI solution that DEP was performing an inspection at the site. Took a picture of well head. Altar 5x was reading 0 ppm for CO, HS % LEL and oxygen reading was in the acceptable level throughout site visit. Ball valve was opened on the well head. Mr. Dischare was going to hammer out the cement on bottom of cellar so he opened the valve and was told to stop any site activity by CNX. WQS dug around in the gravel looking for the extent of the liner. Took readings around well head with boscom meter. Took reading of vent pipe and 0 percent of LEL. Talked to mMr. Dischare about shot distance and may penetrate both casings.
2638288 Primary Facility 2017-09-19 Plugging(Includes Plugged/Mined Through) No Violations Noted Inspected the cellar of plug well. Water was pumped dry along with pad. Few pockets of water were showing in the gravel. Utilized Boscom meter 600 to determine location of gas emitting from well. Bill Daceser from MI solution and coastal crew was onsite. Rig was onsite. Crew was in stand by. Measured reading from vent and showed 0 % LEL. Measured on outside of the. 13 3/8 inch and inside of 9 5/8 inch showed 0 % LEL. Located a crack in the cement between the 9 5/8 inch and 13 3/8 inch pipes and showed a maximum of 13 % LEL. Remaining cellar showed a 0 percent LEL.
2641145 Primary Facility 2017-09-27 Plugging(Includes Plugged/Mined Through) No Violations Noted Arrived at 830 am to observe several well test. From cnx, Patrick Taylor. Mich Goodwin, Spencer Johnson, and Evan Olsak were present. From EPA, David Ricktenal was present. Eve downhole wireline was present with Jarod Hobbs, Chuck Valrez were present. Cnx performed safety meeting. Site was prepared to perform a bond log and video camera of the well. From 11 am to 1:30 pm, video camera was run several times from surface to 340 feet. Blockage of heavy fluid would not allow camera to reach the top of cement at 795 feet. Camera was run to determine the structural integrity of the well and determination of gas bubbles. A bond log was run on the well from 2:30 pm to 4:30 pm. The bond log reached 380 feet and was stopped due to heavy fluid in the well.
2641299 Primary Facility 2017-09-19 Routine/Partial Inspection In Compliance with Policy On site inspection in response to Inspection Record #2637084 where Department observed standing fluid on well pad and fluid overtopping well cellar. Samples were collected during the 9-13-17 inspection and that inspection result is PENDING receipt and review of sample analysis and further investigation.

At the time of this inspection, WQS Cindy Witham, WQS Samantha Foulk, and WQSS April Weiland present for Department. CNX subcontractor Bill Decesa present. Altair 5X and Bascom Turner units were utilized during this inspection. Dozer, excavator, roll off box, water truck on site. Soil located on liner on E side of pad. At time of inspection small areas of standing fluid observed on pad. Intermittent bubbling observed in some of these areas. Department observed approximately 2" of water and a minimal amount of mud/sludge in the well cellar (photo 1). No bubbling observed in the fluid of the cellar at this time. Samples were collected during 9-13-17 inspection and that inspection result is PENDING receipt and review of sample analysis and further investigation.

At the time of this inspection, WQS Cindy Witham, WQS Samantha Foulk, and OGI Paul Wyrwas present for Department. CNX subcontractor Bill Decesa present. Altair 5X and Bascom Turner units were utilized during this inspection. At time of inspection well cellar surrounded by orange security fence. Cellar appears almost completely empty of fluids; sheen observed. No bubbling observed. Sludge/solid material remains in cellar. According to Mr. Decesa, water truck pumped fluids from cellar at 10:30 and approximately 10 gallons were removed at that time. 7/17 to 8/17. Well was plugged. CNX contracted MI Solution. MI set five cement plugs at 7727'-8023' (296'), 5507' - 5850' (343'), 2625'-3300'(625'), 1350'-1950' (600'), 1350'-730' (620'). Bentonite gel (6%) was used at 3300' - 5507' and 1950' - 2625' intervals. From 730' to surface, well was swabbed and remained open and monument was set.

2658077 Primary Facility 2017-10-30 Routine/Partial Inspection Outstanding Violations - Viols Req'd On site inspection in response to Inspection Record #2637084 where violation was issued for operator failure to control and dispose of fluids.

At the time of this inspection WQS C Witham and OGI P Wyrwas present for Department. Altair 5X and Bascom Turner units were utilized during inspection. The temperature is approximately 46 deg F, high winds. At time of inspection, fluid observed on site (see photo #1) and overtopping well cellar (see photo #2). No bubbling was observed on well pad; bubbling was observed in fluid located in cellar. This bubbling was intermittent. Altair and Bascom Turner units did not record gas/did not alarm during this inspection. Five brine tanks remain on site. Northernmost brine tank appears structurally compromised (see photo #3). Department collected samples of fluid in well cellar. UPDATE 13:15: Department returned to collect additional samples. Department left site at 14:05. Violation for failure to control and dispose of fluids remains outstanding. A follow up inspection

DEP OGI Paul Wyrwas present during inspection. Altair 5X and Bascom Turner units were utilized during this inspection. Winds were gusty, temp approx 50 degrees F. Empty roll off box and frac tank on site. At time of inspection one 3' X 2' area of standing fluid observed on well pad (photo #1). No bubbling was observed in this area. The rest of the pad appears mostly dry (photo #2). Well cellar surrounded by security fence. Cellar appears almost entirely empty of fluid/sludge (photo #3). The well casing appears open to the air. No gas readings were detected by either gas meter near cellar area. Brine tanks and bbl's observed in earlier inspections have been removed from site. Operator response to violation (received 11-21-17) indicated operator will provide information on the structural integrity of the liner system and provide he Control and Disposal plan to Department. Well cellar full of fluid No bubbling observed in this fluid. A grate has been installed over the well cellar. A vent has been installed that extends above cellar level and appears to be equipped with flow monitoring equipment (photo #2). The pressure gauge reads zero pressure and it appears that the well is vented to the atmosphere. Neither the Altair nor the Bascom Turner units alarmed or detected elevated gas readings during this inspection. Operator response to violation indicated operator will provide information on the structural integrity of the liner system and provide the Control and Disposal Plan to Department. Operator rep Spencer Johnson contacted Department by email (photo #1). Mr. Johnson provided information pertaining to the site PPC Plan, Control and Disposal plan, and liner installation. According to this documentation, a 10 mil synthetic liner was placed over the subsoil, a 6 inch cushion of sand or clean earth was placed over the liner, and a 6 inch layer of clean crushed rock was placed over the cushion layer. Based on this documentation and the fact that the dike appears to hold fluid, the secondary containment for this site appears to be functioning as intended. Department requests operator inform Department when site is being restored and liner is being removed so Department can visually inspect liner. Violation issued on 9-13-17 has been closed. Violation(s) may be issued based on inspection of structural integrity of liner or other future inspections.
