2596854 Primary Facility 2017-05-16 Administrative/File Review In Compliance with Policy Admin inspection in response to inspection record 2596314 for the reportable release of 20 gallons brine.

Upon receipt of spill report at 1504, Department called operator representative Spencer Johnson. Per Mr. Johnson: A release of 20 gallons brine water occurred as a result of a dripping waterline adjacent to the well. The release was discovered by the well-tender at approximately 1300 when he observed a "wet area" located down-gradient from the waterline. The release was subsequently reported to the Department at 1415. Upon discovery, the valve was shut in, stopping the leak. The size of the area impacted is unknown at this time. Pooled fluids have been cleaned up. A third party contractor is scheduled to collect samples and remediate the site tomorrow morning. No waterways are reported to be impacted. Mr. Johnson believes the quantity released is based upon tank readings and the area of impact. The well-tender was last at the site in April 2017. 2596858 Primary Facility 2017-05-17 Incident- Response to Accident or Event Violation(s) Noted At time of inspection, excavation of impacted materials not yet commenced. The Department observed an area approximately 10'x25' in size characterized by reddish muddy soils with no vegetative growth. When standing at the access road, this area is located on the hillside behind the well. It appears that the compromised waterline that the operator reports resulted in the release is located underground. What appears to be a tributary leading to Whisky Run is located approximately 10 feet from the visually impacted soils. No visual impact to this tributary observed during this inspection. No measures are currently in place to prevent any potential contaminants from reaching Waters of the Commonwealth.

Well drilled and appears equipped for production. Pumpjack installed on well. Well label present. Department recommends operator replace well tag on well in a legible, visible, and permanent manner per current regulations.

Violations are being issued for this reportable release.

2598199 Primary Facility 2017-05-17 Administrative/File Review In Compliance with Policy Admin inspection in response to inspection record 2596314 for the reportable release of brine water.

Department contacted operator representative Spencer Johnson in response to on-site inspection (inspection record 2596858).

Department recommended that measures are promptly implemented in order to prevent any additional potential pollution events from occurring to Waters of the Commonwealth. Mr. Johnson agreed to implement the Department's recommendation. The Department requested the operator re-assess the quantity of brine released. Mr. Johnson agreed to do so. Mr. Johnson stated that he is currently en route to the site and will follow-up with the Department upon leaving the location.

2598929 Primary Facility 2017-05-25 Follow-up Inspection Outstanding Violations - Viols Req'd On-site FUI conducted in response to violations issued under inspection record 2596858 (enf ID 353657) for failure to properly control and dispose of production fluids.

At time of inspection, all visibly impacted materials appear to have been excavated, backfilled, seeded/mulched, and is not yet exhibiting 70% uniform and adequate vegetative growth. Temporary BMPs installed down-gradient of this earth disturbance. No visible impact to nearby tributary observed during this inspection.

Operator appears to be in compliance with schedule insofar as the operator has outlined and performed a schedule of remediation activities. Outstanding violations have been corrected. No new violations are being noted at this time. Violations may be forthcoming pending future inspections assessing site remediation and permanent stabilization.

2653078 Primary Facility 2017-10-19 Routine/Complete Inspection No Violations Noted On-site inspection conducted to monitor the remediation of the site in response to violations issued under inspection record 2596858 for the reportable release of production fluids. Violations were corrected under inspection record 2605602.

At time of inspection, area of excavation backfilled and exhibiting vegetative growth. Vegetative growth is not yet 70% uniform and adequate; the Department recommends the operator re-seed/mulch as necessary in order to promote additional vegetative growth for permanent stabilization of the site. Temporary E&S BMPs remain installed and shall be properly removed upon permanent stabilization of the site.

Additional violations may be forthcoming pending future inspections monitoring the remediation and permanent stabilization of the site.

2655739 Primary Facility 2017-10-24 Administrative/File Review In Compliance with Policy Admin inspection in response to inspection record 2653078.

The Department contacted operator representative Spencer Johnson by phone. Per Mr. Johnson: Following the Department's notification on 10/19/17, personnel were immediately sent to the site. The packing was replaced which corrected the issue.

The Department recommends the operator continue to monitor and maintain all production equipment as necessary in order to prevent any potential pollution events from occurring.
