2565681 Primary Facility 2017-02-23 Administrative/File Review Violation(s) Noted At 1349, Operator representative Spencer Johnson left a voicemail with Department WQS Foulk regarding a spill notification. At 1458, the Department returned Mr. Johnson’s phone call.

Per Mr. Johnson, a voicemail was left with the SWRO at 1335 in accordance with the Spill Policy. A return call to Mr. Johnson from the SWRO has not yet been received. Mr. Johnson has not yet been to the location, but reports that the Production Foreman is currently on-site. According to Mr. Johnson, a 12 bbl release of “oily water” occurred from a brine tank onto the ground. Although 12 bbl was reported to be missing from the tank as calculated by the tank readings, the visual impact on the ground appears to be less than 12 bbl. Mr. Johnson stated that the release resulted from a valve failure caused by a freeze/thaw cycle. No waterways have been impacted. Mr. Johnson is currently unsure whether there are any nearby waterways. Mr. Johnson believes the area of impact is small and does not know if the tank was actively leaking

2566989 Primary Facility 2017-02-24 Follow-up Inspection Outstanding Violations - Viols Req'd Follow up inspection to inspection record #2565681 where a violation was issued on 2-23-17 for a reportable release of residual fluids.

At time of inspection Spartan arriving on site with truck and excavator. Operator Rep Richy Vrobel on site during inspection. Mr. Vrobel stated well tender had been on site on 1-26-17 and again on 2-23-17, when the 12 bbl release was discovered. Release occurred due to a cracked valve and released fluids collected in a low area near/around separator. Upon discovery of release, well tender used booms and absorbent mats to contain fluids. Well tender also removed separator and excavated (using a shovel) a small area in order to replace the valve. At this time Spartan preparing to remove impacted soils. Department observed an oily sheen on soil near brine tank. Department recommends Operator test for COC's for brine and for hydrocarbons to ensure remediation efforts are complete and all impacted soils are removed. Mr. Vrobel stated excavation should be completed by end of the

2569918 Primary Facility 2017-02-23 Administrative/File Review Outstanding Violations - Viols Req'd Admin inspection conducted as follow-up to inspection record 2565681 (enf ID 351304) for the reportable release of oil and production water.

At 1552, the Department contacted Operator representative Richy Vrobel via phone. Per Mr. Vrobel: Two production tanks are piped together and the valve between these two tanks cracked, resulting in a 12 bbl release of production water and oil. The valve has since been replaced and it is no longer leaking. The valve was leaking when the well tender discovered the release today. The tank was nearly empty when the release was discovered. The visual area of impact is approximately 12’x12’. The fluids traveled into a depression underneath the separator. The fluids were removed and there are booms and absorbent pads in place. The spill is contained and there are no waterways impacted. Spartan will be on-site in the morning to begin remediation activities. 2569949 Primary Facility 2017-02-23 Administrative/File Review Outstanding Violations - Viols Req'd Admin inspection conducted as follow-up to inspection record 2565681 (enf ID 351304) for the reportable release of oil and production water.

At 1607, Operator representative Spencer Johnson electronically provided the Department with a photo of the area of the release. E-mail includes additional information surrounding the release. See attached. Violations issued under inspection ID 2565681 (enf ID 351304) remain outstanding.

At 1457, the Department requested via e-mail that the Operator provide the quantity of oil released versus the quantity of production water released. At 1534, Operator representative Spencer Johnson notified the Department that approximately 3 gallons of oil was released. See attached. 2571528 Primary Facility 2017-03-01 Administrative/File Review Outstanding Violations - Viols Req'd Admin inspection conducted as follow-up to inspection record 2565681 (enf ID 351304) for the reportable release of oil and production water.

In reference to the Spill Policy, a 15 day response was provided to the Department via e-mail on 2/28/2017 by Operator representative Spencer Johnson notifying the Department that the Operator will be utilizing the Alternative Remediation method for the remediation of this release. Upon review of this 15 day response, the Operator did not identify all constituents of concern that will be analyzed and the method of attainment for remediation that will be utilized for each constituent. The Department requested that a list be included with the 15 day written response that identifies all constituents of concern that will be analyzed under the chosen method of attainment for remediation. The Department also provided the October 3, 2014 Program Clarification Memo for guidance. Violations issued under inspection ID 2565681 (enf ID 351304) remain outstanding.

2571909 Primary Facility 2017-03-09 Follow-up Inspection Outstanding Violations - Viols Req'd On-site FUI conducted in response to violations issued under inspection record 2565681 (enf ID 351304) for the 2/23/17 reportable release of 12 bbl oil and production water.

At time of inspection, well appears equipped for production. According to records, drilling occurred 3/27/2000-3/30/2000. Pumpjack installed on well. Well label present. Department recommends Operator replace well tag on well in a legible, visible, and permanent manner per current regulations. Two brine tanks on-site, both appear sound. Area of excavation appears to have been backfilled and is permanently stabilized with gravel. Areas of well site that appear to have been disturbed as a result of spill remediation activities are temporarily stabilized with mulch. Access road stabilized at this time. Department recommends Operator continue to monitor and maintain access road and well site as necessary in order to prevent any potential pollution events from occurring. Department contacted Operator representative via email to receive clarification on 15 day response received via e-mail on 3/23/17 (inspection ID 2578228). As only a constituent list for crude oil was provided with this response, the Department confirmed with Mr. Johnson that the following common constituents of a brine release were also sampled for under the Alternative Remediation method: Aluminum, barium, boron, chloride, iron, lithium, manganese, strontium, vanadium, zinc, selenium.

Operator appears to be in compliance with policy at this time insofar as the Operator has identified their intent and schedule for remediation in accordance with the Department’s Spill Policy. Violations issued under inspection record 2565681 (enf ID 351304) for this reported release have been closed.
