2262399 Primary Facility 2014-04-14 Incident- Response to Accident or Event Violation(s) Noted Oriskany.On-site inspt conducted as follow-up to admin inspt 2261360 for a reportable release of brine water to ground.At time of inspt, Opr reps Jamie Komonich, Ryan Scrips and contractors on-site.Excavation of contaminated soils completed.Materials removed amount to 310 tons.Silt fence installed around perimeter of excavated areas.Two 115 bbl brine tanks on-site, both previously emptied, placed on containment.Per Mr. Komonich, a 115 bbl brine tank overflowed due to a faulty valve, leading to a release of approx 140 bbl of prod water into earthen dike.Initial clean-up involved vac'g 130 bbl brine out of the dike; approx 10 bbl overflowed out of dike down-gradient into adj ag field.Drilling occurred 8/14/82-9/1/82.AR stable.Opr will be utilizing the attainment method of alternative remediation.Dept requests all disposal records and manifests upon final disposition of wastes.

2267602 Primary Facility 2014-05-01 Follow-up Inspection Violation(s) & Outstanding Violations FUI to 4/10/14 viols ( record 2262399, enf ID 309839).Dept observed accel E&S on AR w/sediment traveling off road into nearby waterway.Pt where sediment enters waterway is very turbid & yellow-brown.Upstream waterway appears clear.Dept followed downstream waterway to trace extent of sediment travel; however, waterway eventually flows underground, potentially recharging a nearby down-gradient (private) pond.Samples collected upstream of pt source pollution, at pt source pollution, & downstream of pt source pollution at pt where stream flows underground.Dept notified EH&S personnel Doug Manners via phone of pollution event in add'n to recomm'd maintenance of silt fence & secondary containment.Mr. Manners stated he would immediately notify other appropriate parties in order to dispatch personnel for follow-up response.New viols issued under 401CSL & 102.4.Outst viols exist under 78.54 & 78.57A.Accomp'd by WQSS April Weiland.Dept spoke to Opr reps J.Komonich & R.Scrips who stated personnel would respond tomorrow.Additional comments on paper copy.

ERP located at AR entrance.Outstanding violations exist under 25 PA CODE 78.57A. No new violations noted at this time.
2274455 Primary Facility 2014-05-22 Follow-up Inspection Outstanding Violations - No Viols Req'd Oriskany.On-site FUI in response to viols issued under record 2262399 (enf ID 309839) and issued under record 2267602 (enf ID 310639).At time of inspection, silt fence installed around perimeter of excavated areas.Two emptied 115 bbl brine tanks on containment. Both silt fence and containment have been maintained per Dept's previous recommendations (record 2267602).Dept still awaiting confirmatory sample results verifying all impacted materials have been excavated.Operator has rocked access road where accelerated E&S event occurred as a stabilization measure in order to prevent a subsequent pollution event from occurring. Department recommends Operator continue to add rock as necessary and continue to monitor and maintain access road and associated BMPs in order to prevent a subsequent potential pollution event from occurring.Violations issued under record 2267602 (enf ID 310639) have been corrected. Violations issued under record 2262399 (enf ID 309839) remain outstanding. No new violations noted at this time.
2280895 Primary Facility 2014-06-16 Administrative/File Review Outstanding Violations - No Viols Req'd Admin inspt in regards to violations issued under inspection record 2262399 (enf ID 309839) for the 4/10/2014 reportable release of 140 bbl brine water to ground.Review of e-mail received by Department from Operator representative Carrie Crumpton (See Attached). As indicated in the e-mail, interim remedial efforts are being devised as post-excavation sample results reveal that additional excavation may be warranted in order to achieve background standards, as previously chosen by Operator as the alternate remediation clean-up standard.

2376760 Primary Facility 2015-05-26 Compliance Evaluation No Violations Noted Oriskany.On-site CEI in response to viols issued under record 2262399 (enf ID 309839) for 4/10/14 reportable release of 140 bbl brine water to ground.At time of inspt, entire area of excavation backfilled, seeded, mulched.Backfilled area extending into ag field displaying mod veg growth.More recently backfilled area up-gradient of ag field displaying min veg growth.Dept recom'nds Opr ensure areas have been properly backfilled and cont' to monitor/maintain all tem E&S BMPs as necessary in order to prevent any potential pollution events from occurring.As approval has been received by ECB for the Alternative Remediation Method as identified under the Dept’s Spill Policy and the site is backfilled, viols issued under inspt record 2262399 (enf ID 309839) have been corrected. A follow-up inspection is anticipated to be conducted in the future to ensure site is properly restored as per current regulations.
