2771092 Primary Facility 2018-09-05 Administrative/File Review In Compliance with Policy ADMIN inspection in response to an operator reported release of approximately 15 bbls of produced water/brine. Department contacted operator rep Kirk Elkin by phone. Mr. Elkin states that the brine tank valve was knocked off by a farmer mowing grass. Mr. Elkin also states the released fluid soaked into the ground near the brine tank and temporary BMP's will be installed as necessary. In addition, Mr. Elkin states the brine tank is not located in an earthen dike and he does not feel waterways are impacted.

Operator appears to be in compliance at this time. A site inspection will be conducted at a later date.

2774833 Primary Facility 2018-09-11 Incident- Response to Accident or Event Violation(s) Noted Inspection conducted in response to an operator reported release of 15 bbl of brine on 9-5-18.

At time of inspection brine tank valve struck by farmer (see inspection record #2771092) has been replaced with a plug (photo #1). It appears when the release occurred the brine flowed down-gradient (NNW), off site, and into a nearby wooded area. An area of stressed vegetation is observed starting at the brine tank (photo #2) and continuing approximately 60' into the wooded area (photo #3). No temporary BMP's are installed at this time. It does not appear that remediation efforts have begun at this time. Department contacted operator rep Kirk Elkin by phone. Mr. Elkin states he feels the brine soaked into the ground and BMP's are not needed. Mr. Elkin also states clean-up has been delayed due to contractor being delayed due to flooding in the area but excavation will take place soon. 2777333 Primary Facility 2018-09-19 Follow-up Inspection Outstanding Violations - Viols Req'd Follow up inspection to inspection record #2774833.

At time of inspection contractor on site improving access road. It does not appear any site remediation efforts have begun (photo #1). Dead/stressed vegetation in wooded area down-gradient of brine tank observed in above inspection record remains (photo #2). At the time of this inspection it appears that the furthest reaches of the dead/stressed vegetation has lengthened approximately 6' (photo #3) from what was observed by Department on 9-11-18 (see above inspection record). A Compliance Order was issued on 9-14-18. A violation is being issued for failure to recover or remove the released substance in accordance with DEP regulations. Violations issued on 9-11-18 remain outstanding. A follow up inspection will be conducted at a later date.

2778504 Primary Facility 2018-09-21 Follow-up Inspection Outstanding Violations - Viols Req'd Follow up inspection to inspection record #2774833.

At time of inspection it appears impacted soils have been excavated (photos #1-3). An area approximately 26' X 67' has been excavated down-gradient of brine tank. Brine tank remains on site. Department recommends operator monitor stability of brine tank due to excavation of soil near tank. Temporary BMP's (CFS) is installed down-gradient of excavated area (photo #4). Impacted soil has been removed from site. Department contacted operator rep Kirk Elkin by phone. Mr. Elkin states excavation is complete and soil samples results are expected to be received next week. Mr. Elkin states that, depending on sample results, site may be backfilled, seeded and mulched next week. Mr. Elkin states he thinks the brine tank is empty and will monitor the ground around the tank to ensure it is stable. Department requests disposal manifests be provided to Department. 2781409 Primary Facility 2018-09-25 Administrative/File Review Outstanding Violations - Viols Req'd Follow up inspection to inspection record #2774833.

Department received operator response to NOV and Compliance Order (photos #1-2). Violations issued on 9-11-18 remain outstanding. A Compliance Order was issued on 9-14-18. A follow up inspection will be conducted at a later date.

At time of inspection area of excavation is protected by security tape (photo #1). Excavated area has not been backfilled at this time (photo #2). Temporary BMP's observed in inspection record #2778504 remain installed down-gradient of excavated area (photo #3). No E and S issues are observed at this time. Department recommends operator continue to monitor and maintain site to avoid any E and S issues. A Compliance Order was issued on 9-14-18. Violations issued on 9-11-18 remain outstanding. 2786310 Primary Facility 2018-10-03 Follow-up Inspection Violation(s) & Outstanding Violations Follow Up inspection to inspection record #2774833.

At time of inspection excavated area is not backfilled (photo #1). CFS remains installed down-gradient of excavated area (photo #2). Site does not appear to be temporarily stabilized. On 9-21-18 Department notified operator regarding concerns of site not being temporarily stabilized (inspection record #2778504). As per current regulations (102.22 (b)1), upon temporary cessation of earth disturbance activity where cessation of activity will exceed 4 days, the site shall be immediately seeded, mulched or otherwise protected from accelerated erosion and sedimentation. A violation is being issued for failure to temporarily stabilize a site after earth disturbance activity. At this time Department has not yet received Disposal Manifests requested on 9-21-18. Violations issued on 9-11-18 remain outstanding.

2786860 Primary Facility 2018-10-10 Follow-up Inspection Outstanding Violations - Viols Req'd Follow Up inspection to inspection record #2774833.

At time of inspection area of excavation appears to have been backfilled, seeded, and mulched (photo #1). Vegetation is beginning to grow (photo #2). CFS remains installed down-gradient of excavated area (photo #3). No E and S issues observed at this time. Department recommends operator continue to monitor and maintain area of excavation to ensure site reaches permanent stabilization. At this time Department has not yet received Disposal Manifests requested on 9-21-18. Violations issued on 9-11-18 and 10-3-18 remain outstanding. At this time Department has not yet received Disposal Manifests requested on 9-21-18. Due to this lack of documentation, Department is unable to determine if excavated soil was disposed of by a method permitted by law. Violations issued on 9-11-18 and 10-3-18 remain outstanding. Department received email from operator rep Kirk Elkin (photo #1) providing disposal manifests (see attached). These manifests were requested by Department on 9-21-18. Department received SCR/RACR (see attached) via email (photo #2) from Moody and Associates Inc. on behalf of Diversified Oil and Gas. Department recommends operator continue to monitor and maintain site to ensure permanent stabilization is achieved. Violations issued on 9-11-18 and 10-3-18 remain outstanding. A follow up inspection will be conducted at a later date.

2805452 Primary Facility 2018-11-16 Compliance Evaluation No Violations Noted Compliance Evaluation Inspection to inspection record #2774833 and #2786310.

At time of inspection site snow-covered (photo #1). Area of excavation that was back-filled appears vegetated (photo #2-3). Although site is snow-covered, no E and S issues observed at this time. Temporary BMP's remain installed down-gradient of excavated area (photo #4). Operator appears to be in compliance with policy at this time. Operator appears to be in compliance with Compliance Order at this time. As per inspection record #2800838, Department received SCR/RACR from operator rep Moody and Associates Inc. and this document is currently under review by the Department. Operator must still abide by the requirements of the Alternative Remediation method. Violations issued on 9-11-18 and 10-3-18 have been corrected.
