2012343 Primary Facility 2011-10-17 Follow-up Inspection Pending Upon inspecting this new well pad I found a portion of the site appeared constructed on a wetland. The well pad site was partially constructed, requiring more stone and BMPS. The access road was stoned and in good repair. Some slit fence was installed but failing. The E&S plan was on site, and it indicated no wetlands ? I will investigate the site further before determining if a enroachment and wavier violation exsist.

2012557 Primary Facility 2011-10-21 Follow-up Inspection Outstanding Violations - No Viols Req'd Today my supervisor Scott Lux and I met Enervest Drilling Supervisor, Jeff Foley, on-site to review and discuss the outstanding violations of Chap 105.11, 102.4(b)(5) and 205(b) of the Oil and Gas Act at this partially constructed well pad site. I explained that the well pad had been constructed in a wetland, and the E&S Plan was incorrect in stating there was no wetlands at the site. I also explained that a variance would have to be obtaine to have the well site clsoer than 100' to a wetalnd. Jeff Foley explained that they needed to get a rig on the site thsi weekend, and ask what we could do to work with them. Scott Lux explained one option to allow the site to be used thsi weekend, would be to move the well site stake 40' to the west, up gradient , and away from the wetland, thereby moving the well pad away and equipment away from the wetland. Scott further required the operator contact the DEP to setup a pre-drill inspection of one of the pits to verify the bottom of the pit is 20" above the water table. Mr. Foley agreed to complete th work.

2014478 Primary Facility 2011-10-27 Follow-up Inspection Outstanding Violations - No Viols Req'd Follow-up inspection to determine if the operator completed the steps required to mitigate the wetland encroachment operator created while constructing this new the well pad. Upon inspection I found the well stake had be moved 40 ft back up slope as requested, and the additional BMPs are in place as required. All water and soil are contained on the site. The operator has submitted a new plat to NWRO of DEP as required.

Upon inspection I found the well bore had been moved as required and the BMPs in place. The well pad was rough graded with the slit fence in palce and both pits still open.

The well pad has been rough graded and is currently very muddy, but stabile. The slit fence remains in place. The pits are still open with over 2' of freeboard. Clear water is flowing up from the ground on the SW site, and runing clear across the site to a sump. Final reclaim will be in summer of 2012.
