On 12/3/18 at 2:50pm, a release of 4 bbl brine water was reported to SWRO representative Lynn Ponchione by operator representative Joshua Mart.

Release was reportedly discovered on 12/3/18 at 1:35pm. No waterways reported to be affected.

Operator currently has a water hauling truck en route to empty the tank.

2810914 Primary Facility 2018-12-03 Administrative/File Review In Compliance with Policy Admin inspection conducted in response to release of 4 bbl brine water reported under inspection record 2810907.

Upon receipt of the spill report, the Department contacted operator representative Joshua Mart by phone.

Per Mr. Mart: A release of 4 bbl brine water was discovered by the well-tender at 1:35pm today (12/3/18). The amount released was calculated utilizing tank readings; the tank was measured at the beginning of last week. The released fluids are contained within an earthen dike and appear to be the result of a previous patch job on the tank that developed a slow leak. The dike is believed to be unlined. There are no nearby streams and/or waterways.

Per Mr. Mart: The leak has stopped. A water truck is en route to the site to remove the remaining fluids from the tank. After delineation of the release, the impacted soils will be immediately excavated.

Operator appears to be in compliance at this time. An on-site follow-up inspection will be conducted to assess any environmental impact and/or is

2810930 Primary Facility 2018-12-04 Routine/Complete Inspection Violation(s) Noted Inspection conducted in response to an operator reported release of 4 bbl of produced water on 12-3-18.

At time of inspection brine tank, located in an earthen dike, appears unattached to production equipment (photo #1). Brine tank has been moved from center of dike and is propped up on one side by blocks of wood (photo #2). No fluid is located in the dike at this time. Department contacted operator rep Josh Martz by phone. Mr. Martz states an error was made by temporary well tender and operator feels that only 2-3 gallons leaked from tank, not the 4 bbl originally reported. Mr. Martz also states the brine tank has been emptied. Mr. Martz would like to meet Department on site to evaluate area and ensure remediation plan is adequate. A site meeting is scheduled for 12-6-18. 13:39- Mr. Martz contacted Department by email (photo #3) which included photos of the site (attached). Violations are being issued for failure to collect brine or other fluids and for operator disposal of residual waste inconsistent wit

2811850 Primary Facility 2018-12-06 Follow-up Inspection Outstanding Violations - Viols Req'd Follow Up Inspection to inspection record #2810930.

Present during inspection is operator rep Josh Martz. At time of inspection brine tank, located in an earthen dike, appears unattached to production equipment. Mr. Martz states that an error was made by temporary well tender and operator feels that only 2-3 gallons leaked from tank, not the 4 bbl originally reported. Department and operator collected soil probe readings at various points around earthen dike area. Based on these readings it does not appear that a 4 bbl release occurred at this site. A small area near center of dike exhibits elevated conductivity levels. This area is marked for removal and Mr. Martz states soil will be excavated in the near future. Department recommends operator ensure impacted soil is disposed of in a manner permitted by law. Mr. Martz also states a photo will be provided to the Department once excavation is complete. At this time Department has not received operator response to NOV. Violations issued on 12-4-18 remain outstanding. A follow up inspection will be conducted at a later date.
