The site showed no sign of accelerated erosion or sedimentation on the access road or well pad area. The drill pit located onsite was excavated but not lined. The Department suggest the operator place a site sign and place the E&S plan in a tube. The Department suggest the operator continue to monitor the site on a weekly basis and after significant precipitation event to ensure erosion and sedimentation from leaving the site.

2108508 Primary Facility 2012-09-06 Follow-up Inspection Violation(s) & Outstanding Violations Also during the inspection the Department observed white fluid running down the backside of the well pad. After following the material back to its source the Department discovered an open top tank, which contained what appeared to be Bentonite and cement returns. That tank appeared to have a hole in the bottom resulting in the discharge of the substance to the ground. The tank also had less than 2 feet of freeboard. The leaking tank did not appear in the violations written on 8/21/2012. The Department immediately called the Operator to report the findings. The Operator immediately started pumping down the leaking tank. The associated violation are separate from and in addition to those written on 8/21/2012.

This review addresses the violations written on 8/21/2012 concerning the compromised liner and freeboard.

On 10/4/2012 the Department observed and sampled a leaking baker tank located on site. The sample results were returned to the Department on 10/23/2012. The sample results show no significant contamination the resulting violations have been removed.

The well apparatus, brine tank, and pump jack appear to be in sound condition. The pit located on site appears to be in sound condition with the required 2' of freeboard. No observation of accelerated erosion and sedimentation in relation to well pad or access road. The E&S plan was onsite and appears to be implemented and maintained as outline in the plan. The Department suggests the operator continue to monitor the site weekly and after significant precipitation event to ensure the stability of the site is maintained.
2173222 Primary Facility 2012-10-04 Routine/Complete Inspection Outstanding Violations - No Viols Req'd Follow up inspection to violations written on 8/21/2012 and 9/6/2012. At the time of inspection the Department notes that the violations and suggestions for removing the pit and damaged liner don't appear to have been followed. The Operator appears to be in the beginning phases of developing the site to begin stimulation of the well. The Department notes 17 baker tanks located onsite, which appear to contain a fresh water. At the time of inspection one of the tanks appears to be leaking a significant amount of fluid. The Department notified the Operator during the inspection. The Operator responded my sending personnel to stop the leaking baker tank. The Department sampled the tank to ensure the tanks contained fresh water. At the time of inspection the site appears to be in sound condition. No observation of accelerated erosion or sedimentation on the well pad or access road.
