2500497 Primary Facility 2016-07-06 Routine/Complete Inspection No Violations Noted The Department of Environmental Protection (DEP) inspected the SWEPI LP – Fuller 826 well pad (ESX29-117-15-0006) located in Middlebury Twp., Tioga Co. on 7/6/2016 @ 1300 hours. The weather was 80° and sunny. An adequate site ID sign was observed at the entrance to the access road. A copy of the ESCGP-2 and well permit was located in the mailbox. The E&S inspection log shows the site as last being inspected on 6/15/2016 with “construction” noted in the comments.

The Fuller site is currently being constructed by W&D Smith. The access road is completed, but cap rock will be removed to soil cement the base for added stability. ~30% vegetative cover was observed along the access road in the ECB and TRM channels. Please ensure all matting has good contact with the ground to provide optimum erosion control. Cut and fill of the main pad and tank pad are scheduled to be completed by Friday. 2507488 Primary Facility 2016-08-02 Preoperation Inspection No Violations Noted The Department of Environmental Protection (DEP) inspected the SWEPI LP – Fuller 826 well pad (ESX29-117-15-0006) located in Middlebury Twp., Tioga Co. on 8/2/2016 @ 1030 hours. The weather was 70° and sunny. An adequate site ID sign was observed at the entrance to the access road. Copies of the ESCGP-2 and well permits were located in the mailbox. The E&S inspection log shows the site as last being inspected on 7/28/2016 with “E&S working” noted in the comments.

A pre-operational inspection is being conducted at the request of Scott Livermore, SWEPI OSR. At the time of the inspection, the ECB lined channel along the access road, from station 7+00 to 2+00 had been excavated to allow installation of under-drain. The onsite contractor stated water underneath the road has become an issue so some E&S controls were being modified. Additional culverts were also to be installed along the access road to channel water from the under-rain to the infiltration basin. Silt sock was observed where specified on the E&S

2511028 Primary Facility 2016-08-15 Routine/Complete Inspection No Violations Noted The Department of Environmental Protection (DEP) inspected the Fuller 826N site (ESX29-117-15-0006) located in Middlebury Twp., Tioga Co. on 8/15/2016 @ 1300 hours. Jim Townsley, SWEPI LP and I were onsite for the Fuller 826 Spur Pipeline preconstruction meeting, when severely eroded channels and multiple failed BMPs were observed and documented. Please see attached pictures for photo documentation of the following E&S issues:

1) An eroded trench, from accelerated stormwater runoff, was observed in the bottom of roadside channel CC2 from ~stations 8+00 to 5+00.

    a. Erosion has occurred on the embankment above the roadside channel CC2 from ~stations 7+00 to 5+00. The Erosion Control Blankets (ECB) failed causing sediment to erode and deposit into the channel bottom.

2) Channel CC9 appears to have experienced gully erosion. The ECB has washed down into sediment trap 1B. 3) The slope protection on the southeast and west corners of the main pad, and on the SW corner of the tank pad, eroded sending rock and

2527342 Primary Facility 2016-10-11 Routine/Complete Inspection No Violations Noted The Department of Environmental Protection (DEP) inspected the SWEPI LP – Fuller 826 well pad (ESX29-117-15-0006) located in Middlebury Twp., Tioga Co. on 8/11/2016 @ 1430 hours. The weather was 50° and sunny. An adequate site ID sign was observed at the entrance to the access road. Copies of the ESCGP-2 and well permits were located in the mailbox. The E&S inspection log shows the site as last being inspected on 10/7/2016 with “no rainfall last few days. No standing water on location. No noticeable erosion. BM15 moving off location and will be gone by end of day.” noted in the comments.

During the inspection Precision Pipeline was in the process of constructing the Fuller 826 pipeline spur. Parts of the pad were inaccessible due to welding and large equipment activities. The repaired E&S controls appear to be functional. Some areas are growing ~25% vegetative cover. A large amount of deposited sediment was observed in the sediment traps below the fill slope. 2546374 Primary Facility 2016-12-19 Follow-up Inspection No Violations Noted The Department of Environmental Protection (DEP) inspected the SWEPI LP – Fuller 826 well pad (ESX29-117-15-0006) located in Middlebury Twp., Tioga Co. on 12/19/2016 @ 1230 hours. The weather was 20° and sunny. An adequate site ID sign was observed at the entrance to the access road. Copies of the ESCGP-2 and well permits were located in the mailbox. The E&S inspection log shows the site as last being inspected on 12/18/2016 with “No erosion noticed. Snow, ice and water on pad.” noted in the comments. A followup inspection is being conducted to check the status of violations issued 8/15/2016 for accelerated erosion, BMP failure and failure to conduct post-stormwater inspections as specified in the permit.

As of today’s inspection the Ensign 162 rig is onsite drilling the 26H well. The rig is currently at a depth of 11603’. The rig previously drilled the 22H well to a total depth of 19409’. 2574783 Primary Facility 2017-03-22 Routine/Complete Inspection No Violations Noted The DEP accompanied SWEPI representatives, Pat Bernethy, Env. coordinator and Paul Broening, HSE on a site tour of the "clean frac" taking place at the Fuller 826 well site in Middlebury Twp., Tioga Co. on 3/20/2017. DEP reps included myself, Terra Tokarz, Jonathan Pennings, and Sean Vanfleet. The weather was 20 degrees and sunny. US well services was in the process of hydraulically fracturing the 22H well using natural gas powered turbines to generate electricity for the frac. Natural gas was supplied by the existing Fuller 826 spur pipeline. Due to the depth of the Utica formation in this area, two additional diesel generators were operating onsite to provide the extra power needed. US Well Services plans to be onsite until mid-April to frac each of the 4 wells onsite. No violations were noted during the inspection. We departed the site @1100 hours. 2592759 Primary Facility 2017-05-11 Routine/Partial Inspection No Violations Noted I spoke with Phil Tillitt (SWEPI) on site, Completions OSR, he explained that Cudd is drilling out frac plugs. He expects to begin flowback in about 12 days.

EC readings with an Oakton PCSTestr 35: pad--2.3 mS/cm, ditch--0.40 mS/cm, basin beside access road--0.14 mS/cm. Photos of the three reading areas follow. A vac truck is on site and removing the liquid from the pad where it measured 2.3 mS/cm. SWEPI pLans to screen and scrape the pad after equipment is moved off site. Onsite ~1305-1445 hrs.

2597499 Primary Facility 2017-05-22 Incident- Response to Accident or Event No Violations Noted I met Patrick Bernethy on site. We looked at the 22H cellar ring (photo) which had a jackhammer puncture on Friday afternoon May 19, 2017. They plugged the whole in the cellar ring. Today, Bernethy used an Oakton ECTestr 11+ (photo) with a ~3' probe to get EC readings of 1.1-1.8 mS/cm in the trench. There is no liquid pooled in the trench today. I got the following EC readings w an Oakton PCSTestr 35: wheelie trailer containment--5.1 mS/cm, pad--0.60 mS/cm, basin--0.20 mS/cm.

The next day, Bernethy emailed the following construction details about the cellars: they are dug 4-8' deep after conductor is finished w a concrete plug on the bottom, the pvc pipe is set 1' above the bottom and used to suck liquid out.

2606296 Primary Facility 2017-06-20 Incident- Response to Accident or Event No Violations Noted On June 11, 2017 SWEPI reported to the DEP, a ~1 barrel flowback release. Kevin Morgan, Flowback OSR, showed me where that release occurred. A dumpster on site holds the affected pad material they removed (photo). A puddle in the backfilled area gave an EC reading of 0.77 mS/cm.

Kent Jensen (Skagen) showed me their separator system that removes some elements from the flowback. The treated liquid is then piped to 3 wheelie trailers on the pad. Violations immediately corrected cited (78.54) to ESCGP.

2636437 Primary Facility 2017-09-14 Routine/Partial Inspection Pending I spoke with Kent Jensen, of Skagen Energy Services, on site. Skagen is treating the production liquid from the 4 Utica wells on site. They remove solid compounds from it which go into a dumpster. The liquid is then pumped to wheelie trailers. EC readings (mS/cm) with Oakton PCSTestr 35 (calibrated August 31, 2017): puddle near Skagen trailer (photo)--5.1, containment under coupler near Skagen trailer--Or (>19.99), liner containment under Skagen dumpster--2.3. Using their EC meter, Skagen got readings about half as high as the Oakton meter from the same puddles. EC with a Hanna Soil Test read 1.7 mS/cm when inserted into pad material (photo) below puddle that gave 5.1 reading. Skagen and I estimate that puddle at about 10 gallons. Skagen said they will get a vac truck to remove the liquid from their containment and the pad near their trailer.

Skagen is going to communicate with SWEPI about how to remediate the area near the trailer. Violations could be cited pending sample results.

2639391 Primary Facility 2017-09-22 Follow-up Inspection No Violations Noted Puddle on pad gave 0.75 mS/cm reading wih an Oakton PCSTestr 35.
2654712 Primary Facility 2017-10-31 Routine/Partial Inspection No Violations Noted I got electrical conductivity readings with an Oakton PCSTestr 35 in all the secondary containments, and on the pad where the Skagen trailer used to be parked. All readings were <0.20 mS/cm.
2686637 Primary Facility 2018-01-25 Routine/Partial Inspection No Violations Noted The only standing liquid I found on site was between wheelie trailers and separator. Those puddles gave a 1.3 mS /cm reading with an Oakton PCSTestr 35. Air temp 28F. JLP
2695136 Primary Facility 2018-02-15 Routine/Partial Inspection No Violations Noted A puddle on the pad gave an electrical conductivity (EC) reading of 0.51 mS/cm. EC readings taken with an Oakton PCSTestr 35. Air temp 63F. JLP
2767994 Primary Facility 2018-08-27 Routine/Complete Inspection No Violations Noted The DEP conducted a ROUTINE inspection of the SWEPI LP - Fuller 826 well pad located in Middlebury Twp, Tioga Co. on 8/27/2018 @1230 hours. The weather was 83 degrees, partly sunny, winds WSW 6mph and 71% humidity.

The well pad, access road and surrounding controls were inspected. The well pad is currently setup for production with rolloff tanks staged on containment for additional temporary storage of production fluid. The 22H, 24H, 26H and 28H wells were SPUD in 08/2016 and drilled in 12/2016 and completed in 03/2017. These wells appear to be in production. A temporary water line, running from the Cummings Impoundment to the Kinnan well pad, was observed along a portion of the across road and proceeded out the ROW of the Fuller 826 spur pipeline.

Please address any deficiencies noted and contact me with any questions. No violations are noted at this time. We departed the site at 1300 hours.

2840692 Primary Facility 2019-02-15 Routine/Complete Inspection No Violations Noted The DEP conducted a routine inspection of SWEPI's Fuller 826N Well pad in Middlebury Twp, Tioga County on 2/15/2019 at 1045 hours. The weather was partly cloudy and 40 degrees. The pad is currently snow covered.

The Act 9 Sign was observed at the entrance to the site. The E&S Plan was found in the mailbox by the site entrance. The inspection log was found in the mailbox by the production tank. Last inspection was conducted by company personnel on 2/9/2019 and noted no issues.

There are currently 4 producing Utica wells onsite (the 22H, 24H, 26H, & 28H). All fluids that weren't frozen onsite were field measured within normal conductivity ranges & no spills were observed. The small amount of vegetation that was observed under the snow appeared to be well vegetated. No erosional issues were noted. All containment structures were intact and functional.

No violations or issues noted today. I departed the site at 1120.
