Observed mud on SR 217, Larry of North East Energy assured dept broom truck was on the way to clean road. Operator plans to encapsulate drill cuttings but based on Seasonal High Ground Water table, 18-36in, operator will be unable to do so and/or the pit must be constructed 20in above the SHGWT. One unlined pit located onsite, it appears that water was flowing in to pit pit bottom had water present. Based onobservation and SHGWT operator will either have to utilize an above grade pit or tanks. For the time being Larry of NEE took it upon him self to stop construction of pit and pump water out (filter thru bag) based on observation prior to dept¿s insp. It was also noted that during construction, a field drain was hit,cracked,&repaired. Ffield drains may be a slight contributor to water in pit, but SHGWT is <20in minimum. Spoke with Mike Buhite 2-18-11 plan for onsite mtg. Accompanied by WQS Marc Maestra. ES controls present, addtl FF reccommended near soil pile. Monitor all BMP's

2340677 Primary Facility 2015-01-31 Administrative/File Review In Compliance with Policy SPILL.
2340712 Primary Facility 2015-02-02 Incident- Response to Accident or Event Violation(s) Noted Follow-up to inspection record 2340677 for the reported release of an unknown amount of CBM water.Per inspection record 2340677, this release was reported to TAS at 1442. As documented in the attached spill report, the Operator was notified of the release at 1000. Hence, violations are being issued for failure to report a reportable release of brine within 2 hours after discovering or detecting the release.Upon receipt of the spill report, Department contacted Mr. Bucheit via phone at 0900. Mr. Bucheit stated that the landowner notified the Operator on 1/31 at 1000 of the release. The length of time that this release occurred for is unknown. Upon notification, the well was shut off and the fitting fixed.At this time, Mr. Bucheit estimates the quantity of released fluids to be greater than 100 bbl of produced water mixed with coal fines. Stewart Run is not reported to be impacted at this time.Violations issued under 78.54 abd 78.66(b). Add'l viols may be forthcoming. ADD'L COMMENTS ON PAPER SAIR.
