2768993 Primary Facility 2018-08-29 Administrative/File Review In Compliance with Policy ADMIN inspection in response to an operator reported release of 35 gal of brine. Department contacted operator rep Kirk Elkin by phone. Mr. Elkin states that the well had been out of service and when it was put back into service one of the relief valves malfunctioned and released approximately 35 gal of brine to the ground. Mr. Elkin states he instructed the field personnel to use straw and hay bales to soak up fluid and to keep it from migrating. Mr. Elkin does not feel any waterways were impacted.

Operator appears to be in compliance at this time. A site visit will be conducted at a later date.

2769618 Primary Facility 2018-08-30 Incident- Response to Accident or Event Violation(s) Noted FUI to inspection record #2768993 where operator reported a release of 35 gal of brine.

At this time, contractors on site working on production equipment. At time of inspection it appears impacted soil has been excavated. Area of excavation begins near brine tank and extends off-site to the south (photo #1-2). Department recommends operator temporarily stabilize disturbed area to avoid any E and S issues. Hay bales are installed in a trench at the southernmost area of earth disturbance (photo #3). Excavated soil located on a tarp on site. This soil is encapsulated in plastic liner and appears to be contained (photo #4). Violations are being issued for operator discharge of brine or other fluids, and for disposal of residual waste inconsistent with DEP rules and regulations. A follow up inspection will be conducted at a later date.
