2366859 Primary Facility 2015-04-29 Incident- Response to Accident or Event Violation(s) Noted On-site inspt conducted in response to admin inspt 2366831 for the 4/27 reportable release of 11.5 bbl brine water to ground.At time of inspection, all visibly impacted materials appear excavated.Area of excavation surrounded by orange security fence.One covered roll-off box on-site.W/in excavated hole on bottom corner, Dept observed what appears to be a torn black liner and sand, which could be indicative of a compromised encapsulated pit. Dept collected coordinates of the observed torn liner/sand (40-53-55.1, -78-48-57.1) via a handheld GPS unit and also recorded a distance of 9 yards to the wellhead from this same location utilizing a rangefinder.Dept immediately notified Opr rep J.Canose via phone of observation.Mr. Canose will investigate to determine the location of pit encapsulation and burial and notify the Dept of findings. Dept also recommended to Mr. Canose that E&S BMPs are installed down-gradient of excavated areas as necessary.Viols are being issued for this reportable release of prod fluids. **ADD'L comments on paper SAIR**

In accordance with the Spill Policy, the 15 day initial written report was received on 5/18/2015 notifying the Department that the Operator will be utilizing Act 2 for the remediation of this release. The Department acknowledged receipt of the Remedial Investigation/Final Report on October 27, 2015. The Final Report was approved by the Department on 1/27/2016. Operator appears to be in compliance with current policy at this time.
