2617259 Primary Facility 2017-07-14 Routine/Complete Inspection Violation(s) Noted Routine inspection of Frontier Natural Resources LLC Winner 1 Project on July 14, 2017. No one was present during my inspection. The site entrance signage located at the gate entrance has the incorrect operator name, address, and contact information (photo 1). This is a violation of Chapter 78a.55(h)(4)(vii).

This site is covered under ESX11-035-0026; which expired on 12/22/16. A review of Department records indications that no notice of termination has not been approved for this ESCGP; therefore the operator is in violation of Chapter 102.7(a).

The original designed under this ESCGP called for a well pad size of 412 ft. x 362 ft. Currently the pad remains at full built out size (photo 6). In addition, the E&S plans called for a 3 MG freshwater/flowback storage impoundment located just East of the well pad. It appears that this impoundment has been restored (photo 5).

There is one drilled Marcellus well on this pad 035-21116. This well is currently in regulatory inactive status and will expire on 8/21/

2660214 Primary Facility 2017-11-14 Follow-up Inspection Outstanding Violations - Viols Req'd Follow up inspection of Frontier Natural Resources Winner 1 Project on November 14, 2017 regarding a Notice of Violation (NOV) that was issued by the Department on August 14, 2017 pertaining to this well site. Frontier Natural Resources submitted a NOV response letter regarding the violations observed during the July 14, 2017 inspection; the Department received the NOV response letter on August 24, 2017. In addition, Frontier Natural Resources submitted a follow up NOV response letter to the Department which was received on October 2, 2017.

To date Frontier Natural Resources has addressed the following violations: - the 911 site sign has been updated. - the weekly E&S inspection log is up to date.

The following violations remain outstanding for the Winner 1 Stone well site. - the site is covered under ESX11-035-0026; which expired on December 22, 2016. A notice of termination (NOT) has not been approved for this ESCGP; this is a violation of Chapter 102.7(a). - there is one drilled Marcellus well on thi

2789167 Primary Facility 2018-10-12 Routine/Complete Inspection Outstanding Violations - Viols Req'd On October 12, 2018, Department representative Brad Kline and Sue Herzing conducted a routine site inspection at the Winner 1 project. There is 1 well at the site and is currently in regulatory inactive status.

The weekly E&S inspection log was found onsite for review. According to the last entry on the E&S log, the site was last inspected on September 27, 2018. Even though the ESCGP is expired the operator is still required to conduct weekly inspections or after a storm water event in accordance with Chapter 102.4(a) or until the permit is terminated by the Department.

The ESCGP expired on 12/22/2016. Since the ESCGP is expired, no earth disturbance activities can occur until the operator obtains a new ESCGP from the Department.

The Department recommends applying for a new ESCGP and restoring the site.

Multiple violations are still outstanding.
