2734511 Primary Facility 2018-05-24 Incident- Response to Accident or Event Violation(s) Noted I arrived at the site and met Denny Fennell of Diversified Gas & Oil in response to spill notification #334392. Lisa Raffle of Diversified contacted the Department to report that the well tender discovered at 13:30 hrs. on 5/23 that an animal (presumably a porcupine) had chewed through the 50 barrel poly production tank on the site, causing a release of an estimated 5 barrels of produced water to the ground surface. The affected area was easily noted by the presence of distresses and dead vegetation, with 2 obvious strips beginning at the tank and running to the west, and another less easily seen strip running to the northwest. Using my Hanna soil probe, I began attempting to delineate the spill area. I found areas of elevated conductance (15-17 mS/cm) in the vehicle ruts ~12' to the southeast of the tank, in both strips of distressed vegetation to the west, and in the strip running to the northwest. 2738734 Primary Facility 2018-06-06 Incident- Response to Accident or Event Outstanding Violations - Viols Req'd I arrived onsite with Tom McNerney of the Department's Environmental Cleanups and Brownfields program and met with Kirk Elkin of Diversified Gas & Oil. Brandon Glowarrk and Jessie Bobrzynski of Moody & Associates were also on location for confirmation sampling. Excavation was nearly complete. Using my Hanna soil probe, I spot checked both the excavated and undisturbed areas, with soil conductance readings from .02-1.69 mS/cm. Kirk informed us that disposal of the contaminated soil had been arranged with a landfill in Ohio. The plan was for Brandon and Jessie to set up a grid for biased sampling of the excavation. While Kirk mentioned on the site that, while they would follow the Act 2 process, they would not seek Act 2 relief of liability. Upon my return to the office, Environmental Group Manager Stephanie Wharton contacted Kirk to inform him that they must pursue the Act 2 relief of liability, as the alternate remediation option is no longer available to either conventional or unconventional operator
