1893493 Primary Facility 2010-06-22 Drilling/Alteration Violation(s) Noted Spud called to DEP on 6/15/10 for 6/16/10 spud date. However, as stated in the DEP regulation, the local municipality and landowner must be notified 24 hrs prior to drilling activity. Currently, a pilot hole was drilled to the open mine shaft. Conductor pipe set at 26¿ using .26¿ 30 mil plastic aligned drilling pit and security fence. Well sign and E&S plan were present at the access road. At the time of inspection, no E&S and IW issues. Adjacent property has potable well to depth of 230 ft and used as a drinking water supply. Inspector was joined by April Wieland, DEP Water Quality and Cambria Twp Police. Township was not notified and shut rig down until the twp ordinance requirements are met.
1893951 Primary Facility 2010-06-22 Routine/Complete Inspection No Violations Noted At the time of inspection, site was properly signed with E&S plan. Well was actively being drilled. Access road was a shared farm road, which was partially rocked. Below grade pit located onsite that sustained more than a 2ft of lined freeboard. Recommend operator continue to monitor liner and/or backfill edges (in addition to sand bags) to ensure liner stays in tack. Filter Fence and brush/grub line installed down gradient from well site and appeared to be functioning. No accelerated erosion or sedimentation issues were observed in relation to access road for well site. It is recommended that operator continue to closely monitor all bmp¿s until final restoration activities are completed. Adjacent property has 230ft deep potable water well which is used for drinking water supply. Operator obtained an approved waiver for distance, <200ft to nearest building/water supply. Accompanied by O&G Inspector Paul Wyrwas & Cambria township police officer. As noted in Paul Wyrwas's inspection # 1893493 on6/23/10 operated failed to notify municipality.
1894664 Primary Facility 2010-06-24 Drilling/Alteration No Violations Noted Spud called to DEP on 6/15/10 for 6/16/10 spud date. Yost drilling drilled to 320 ft. at 24 inch hole and set 18 5/8¿ pipe and was in the process of cementing pipe. At 106 ft, pipe failure at the joint. Yost retrieved 106 ft of pipe and pipe fall in the hole 6 ft causing pipe to telescope and bent. Yost ran a 12 ¿bit to 289 ft. with cement and metal displacing in pit. Vessel ran a caliper but could not run a perf gun due to pipe orientation. According to Bill Roach, pilot hole was plugged with bridge plug followed by cement. No vacuum draw occurred above the pilot hole. Called Mike Arch (Inspector Supervisor) and it was decided to cement the pipe in place. Stratigraphy consisted of SS and shale. At the time of inspection, no E&S or IW issues. No freeboard issues were noted but elevated levels were recorded. Yost/Vessel was making arrangements for disposal of fluids.
1920293 Primary Facility 2010-10-07 Routine/Complete Inspection No Violations Noted At the time of inspection, the well site properly signed with ES plan. Well had not been completed due to pipe failure; subsequently well plugged and cemented. It appears that annulus then filled with rock. Lined pit onsite with adequate freeboard. Filter fence and brush/grub line installed and functioning. No accelerated erosion or sedimentation issues were noted. No IW issues observed. Access road stable. Reminder that operator has nine months from completion/plugging to permanently restore well site.
1960441 Primary Facility 2011-03-24 Site Restoration Violation(s) Noted During this inspection, ID sign and Es plan present. Well not completed, plugged on 6/23/10 due to pipe failure, according to records. Access road stabilized with vegetative growth observed. Site not yet restored nor maintained, it appears no attempts have been taken to permanently stabilize site. Site has not be re-graded, seeded or mulched. Regulation requires that well site be restored within nine months of completion or drilling or plugging of a well. Brush grub line only noted bmp. No accelerated Es noted. One lined below grade pit onsite with < 2ft of required freeboard which is required by regulation; therefore, a violation is being issued. Two violations are being issued for exceeding 2ft of lined freeboard, as well as a failure to restore well site within nine months of plugging.

One lined below grade pit with liquid fraction present at 2ft freeboard level on site. Again well plugged on 06/23/10 after a drilling issue. As per regulation operator has nine months from the date of completion of plugging to restore well site. Hence pits and "drilling materials" located onsite, well site is not considered restored. Access road and pad are stable. No accelerated erosion or sedimentation issues noted at time of this inspection. No new violations noted, but outstanding violations remain.

Well never completed, plugged (6/23/10) due to malfunction during drilling. No well tag or ES plan onsite. PAd adequately rocked. Well site not yet restored, pit remains onsite with liquid contents; it appears that fluid level has receeded since last inspetion;therefore, there is a concern pit liner may have become compromised. Security fence protecting against third party access has also been compromised. NO RESPONSE HAS BEEN RECEIVED FROM OPERATOR TO DATE ON TIMEFRAME/TIMELINE ON CORRECTIVE ACTION MEASURES SINCE INTIAL VIOLATION ISSUED ON 3/24/11. Hence operator has failed to provide written response to violations previously issued department is requestion a 501 conference be conducted with operator to dissuss oustanding violations Department previously reccomended that bond not be released for the site hence final (permaent) restoration activities have not been completed. No New violations noted
