Operator representative notified the Department by phone that the hole has been patched; the tank was previously empty and there was no release of brine water to the ground.

The Department previously notified the operator of a hole in the brine tank in inspection record 2671153. The operator reported that this hole was repaired as documented in inspection record 2671469. During today's inspection, it does not appear that this hole was adequately repaired as previously reported. The hole is approximately 6 inches up from the base of the brine tank. Fluids are actively leaking from the hole and onto the ground. The areas in front of the brine tank are muddy and void of vegetation. This area appears to visibly extend to the left side around the brine tank and then behind the brine tank.

Utilizing a soil conductivity probe, the Department collected the following readings: Background readings ranged from 0.00mS-0.03mS. In the muddy areas in front of the brine tank, readings ranged from 4.76mS-5.37mS. To the left side of the brine tank, readings ranged from 0.31mS-0.33mS. Behind the brine tank, readings range

A written NOV response was requested by 7/27/2018. To date, it does not appear that this response was submitted and/or received by the Department.

2760256 Primary Facility 2018-08-02 Administrative/File Review In Compliance with Policy Admin inspection in response to violations issued under inspection record 2749252.

At 0820, the Department contacted the operator by phone to determine what actions may have been taken in response to the NOV as no written response has yet been received. Operator representative indicated that the message would be relayed to the appropriate personnel.

At 0827, operator representative Mike ("Goose") returned the Department's call. Per Mike ("Goose"): The impacted soils have been excavated, the area backfilled, seeded, and mulched. The brine tank was re-patched, this time using steel wool as a tactic to deter any porcupines from eating the patch as the original patch was reportedly eaten by a porcupine.

Mike ("Goose") stated that he will send pictures of the site to the Department tomorrow as he is currently out of the area today.

2766152 Primary Facility 2018-08-17 Follow-up Inspection Outstanding Violations - Viols Req'd On-site follow-up inspection in response to violations issued under inspection record 2749252.

At the time of this inspection, the hole in the brine tank does not appear to be patched and/or adequately repaired. Due to ongoing and current precipitation, the Department is unable to discern whether the tank is actively leaking.

It appears that the area of the previously impacted soils have been backfilled, seeded, and mulched with minimal vegetative growth emerging. The Department is unable to determine whether the previous release has been remediated in accordance with the Department's Spill Policy as no quantity released has yet been provided to the Department.

The Department is requesting the operator provide the disposal records and/or manifests to the address provided for any impacted materials that may have been removed in response to this release.

2766162 Primary Facility 2018-08-17 Administrative/File Review In Compliance with Policy Admin inspection in response to violations issued under inspection record 2749252.

At 1415, the Department notified operator representative Mike ("Goose") by phone of the hole in the brine tank that does not appear to be patched and/or adequately repaired. Mike ("Goose") stated that everything was all good the last time that he was out there, but he will go to the site now and disconnect the tank and shut off the blow line to the tank. The tank will probably be removed the middle of next week.

Mike ("Goose") estimates that a release of 10-15 gallons occurred as the well hardly produces.

The Department previously requested documentation under inspection record 2749252 that has not yet been received.

Department received operator response to violation (photo #1). Operator appears to be in compliance with policy at this time.

2788987 Primary Facility 2018-10-12 Follow-up Inspection Outstanding Violations - Viols Req'd FUI to inspection record #2749252.

At time of inspection brine tank has been removed from site (photo #1). Area of excavation appears to be seeded and mulched (photo #2). Vegetation is beginning to grow. As of this date, Department has not received disposal manifests from operator (requested on 8-17-18, inspection record #2677152). Violation issued on 7-5-18 remains outstanding. A follow up inspection will be conducted at a later date.

2829275 Primary Facility 2019-01-17 Administrative/File Review Outstanding Violations - Viols Req'd Admin inspection in response to violations issued under inspection record 2749252.

Operator representative Joann left the Department a voicemail on 1/10/19 at 1621 notifying the Department that she talked to Goose - the dirt was encapsulated and buried on location.

Violations remain outstanding. Additional violations may be forthcoming.

2837572 Primary Facility 2019-02-01 Administrative/File Review Outstanding Violations - Viols Req'd Admin inspection in response to violations issued under inspection record 2749252.

The Department contacted operator representative Mike "Goose" by phone. The Department confirmed with Goose that he himself performed the excavation of the contaminated soils at the site and also buried the contaminated soils on-site within a liner. Goose estimated that approximately two 5-gallon bucketfuls were buried and that the brine tank was removed. The Department recommended the contaminated soils are removed from the site in accordance with current regulations; encapsulating the contaminated soils on-site in this manner is not in accordance with current regulations. Goose stated that he will remove the contaminated soils next week, weather-pending, backfill, and seed/mulch the site. Goose stated he will notify the Department once this is completed.

Violations remain outstanding. Additional violations may be forthcoming.

2842170 Primary Facility 2019-02-19 Administrative/File Review In Compliance with Policy Admin inspection in response to violations issued under inspection record 2749252.

The Department spoke to operator representative Joann by phone. Joann notified the Department that a company has been contacted to dispose of the contaminated soils and a soil sample will be collected as part of this process as soon as the weather breaks, possibly the beginning of next week. Joann will keep the Department apprised of any updates.
