The erosions and sedimentation plan was onsite and all associated BMPs appear to installed and functioning as outline in the plan. No accelerated erosion or sedimentation observed. The pit located onsite appeared to in sound condition and had the required 2 feet of free board. The Department suggests the operator continue to monitor the site weekly and after precipitation events to ensure the stability of the site is retained.

Stimulation notice received by the Department on 5/11/2013 set for 5/16/2013. The Department notes that a 1 million gallon above ground freshwater containment vessel was installed and being filled at the time of inspection. The Department suggests the operator continue to monitor the site weekly and after precipitation events to ensure the stability of the site is retained.

No observation of accelerated erosion or sedimentation in relation the well pad or access road. The E&S plan was onsite and all associated BMPs appear to be installed and properly maintained. The Department suggests the operator continue to monitor the site weekly and after precipitation events to ensure the stability of the site is retained.
2199828 Primary Facility 08/29/2013 Incident- Response to Accident or Event No Violations Noted Inspection the result of the Operator reporting a pit overrun and possible BMP failures due to an extreme rain fall event on 8.28.2013. During the inspection the Operator indicated and the Department recognized that the pit that over ran was a lined emergency pit located adjacent to the Kuhns Well pad. The pit was never used to hold any pollutional substances at any point prior to the extreme precipitation event. Also during the inspection the Department inspected the BMPs associated with the adjacent pipeline and well site. The BMPs installed by the Operator appeared to function properly, this fact coupled with the vegetative coverage achieved on the fill side of the well site and the pipeline right of way appeared to limit accelerated erosion and sedimentation. The Department suggest the Operator submit metrological data supporting the extreme rainfall claimed and weekly site inspection report from 7.28.2013 until the event on 8.28.2013.
