| Drilling had been completed at the time of the inspection. The well was not equipped for production.  The following deficiencies were found at this site: 1- The site was not constructed according to the E&S plan that was on-site.  Because this site has a waiver, the approved E&S plan should be followed and any changes should be discussed with the Department prior to implementation.

2- The grub/brush line was installed on the wrong side of the silt fence. 
 
3- There were several instances of failing filter fence. 
 
4- The access road could use additional BMP¿s to limit the amount of sediment entering the stream. 
 
5- The pit installation that was observed at the site could cause undue stress to the integrity of the pit liner and could lead to a tear.

| This inspection was performed as a Compliance Evaluation to a NOV that was issued on 2/9/09.
 
3/2/09- Written response was received from the operator.
 
4/6/09- Jarrod Shultz performed an inspection of the well site.  The well site was equipped for production.  The E&S plan has been revised to include any changes from the original plan.  The filter fence has been repaired and/or replaced where it was needed.  Additional E&S controls (silt fence, hay bales, and seeding & mulching) were added to the access road to assist in controlling Erosion and Sedimentation.  With proper maintenance, the current E&S controls should properly limit erosion and sedimentation of the site and access road.
