| The Department conducted an inspection of Engle #4 well. The well has been plugged. The Department observed a hissing and bubbling sound at the location of the well marker plate. The marker plate is affixed to the casing at ground level. Combustible gas levels (59% LEL) were detected by the Department at the well marker plate.

The operator was notified and agreed to install a temporary vent pipe assembly on the well until the situation can be corrected.

Operator rep Sam Kimmel contacted Department by phone. Mr. Kimmel stated he was aware that he was late in responding to the NOV and that his response will be emailed to the WQS in the near future. Mr. Kimmel stated that no E and S plan was developed because no earth disturbance was conducted. No pit was dug; all fluids/materials normally placed into a pit when plugging were contained in tanks manifolded together. All plugging equipment was then removed and the site was seeded and mulched.

According to operator (see inspection record #2686894), during plugging operations holding tanks were used in lieu of earthen pits. Operator also stated no earth disturbance activities were required during the plugging. Because of this, no E and S plan was created.

At time of inspection, no E and S issues observed on access road or site. Access road and site appear to be mulched. Department unable to determine if any earth disturbance has taken place on site however site appears temporarily stabilized with no E and S issues.

The Department observed a hissing and bubbling sound at the location of the well marker plate. The marker plate is affixed to the casing at ground level. Combustible gas levels (59% LEL) were detected by the Department at the well marker plate.

The operator was notified and agreed to install a temporary vent pipe assembly on the well until the situation can be corrected.

2671803 Primary Facility 2017-12-13 Routine/Complete Inspection Violation(s) Noted Inspection conducted in response to NOI to plug a well received by Department on 11-14-17.

At time of inspection well appears to be plugged. Metal plate located on site with permit number affixed. Plastic pipe located near well head. During inspection, Department heard a hissing sound coming from plate area. This inspection is being referred to OGI Supervisor for OGI follow up. Violation is being issued for failure to have E and S plan on site. Additional violation(s) may be forthcoming.

2682908 Primary Facility 2018-01-16 Administrative/File Review Outstanding Violations - Viols Req'd ADMIN inspection to inspection record #2671803 where violations were issued for operator failure to submit an E and S plan.

Operator rep Sam Kimmel contacted Department by phone. Mr. Kimmel stated he was aware that he was late in responding to the NOV and that his response will be emailed to the WQS in the near future. Mr. Kimmel stated that no E and S plan was developed because no earth disturbance was conducted. No pit was dug; all fluids/materials normally placed into a pit when plugging were contained in tanks manifolded together. All plugging equipment was then removed and the site was seeded and mulched. A follow up inspection will be conducted at a later date.

2686894 Primary Facility 2018-01-25 Administrative/File Review Outstanding Violations - Viols Req'd ADMIN inspection to inspection record #2671803 where violations were issued for failure to develop an E and S plan.

Department received operator response to NOV (photo #1).

2705693 Primary Facility 2018-03-14 Compliance Evaluation No Violations Noted Compliance Evaluation Inspection to inspection record #2671803 where a violation was issued for failure to develop and implement an E and S plan.

According to operator (see inspection record #2686894), during plugging operations holding tanks were used in lieu of earthen pits. Operator also stated no earth disturbance activities were required during the plugging. Because of this, no E and S plan was created. At time of inspection, no E and S issues observed on access road or site. Access road and site appear to be mulched. Department unable to determine if any earth disturbance has taken place on site however site appears temporarily stabilized with no E and S issues. Based on operator response and today's inspection, operator appears to be in compliance at this time. Violation issued under 102.4 (b)2 has been closed.
