| During inspection of the site, I observed a pit which is used to dispose of tophole cement cuttings.  The pit was built on top of the well pad with 2¿ berms, and is lined with plastic.  At the time of inspection, freeboard in the pit was approximately 1¿. The pit appeared to contain some residual oil-based fluid.  I informed the Company Man of the violation, and he indicated the berms would be increased in height to meet the freeboard requirements.

At the time of inspection, the pit was in violation of the 2 feet freeboard requirements.  Shortly after the inspection was completed, the Company Man provided pictures showing the berms of the pit were increased in height to meet the  2¿minimum freeboard requirement.

| During inspection of the site, I observed a pit which is used to dispose of tophole cement cuttings.  The pit was built on top of the well pad with 2¿ berms, and is lined with plastic.  At the time of inspection, freeboard in the pit was approximately 1¿. The pit appeared to contain some residual oil-based fluid.  I informed the Company Man of the violation, and he indicated the berms would be increased in height to meet the freeboard requirements.
