-1102878136 2013-05-15 Compliance Action Follow-up #-1905121104: Dan Goins and I did a follow-up inspection and found that the contamination had been removed from problem areas. New dirt was brought in and operator had thrown down seed and straw. Some areas had grass growing while other areas were still barren. They did not replace the plastic tank which still had a small leak on one of the valves. It was dripping in the dike. I called Jody Jasper and he said if the tank continues to cause problems they will remove it and replace with a new one. I will continue to return to location until there is complete resolution.
-1212705936 2014-03-28 The transfer tank battery has crude in the dike due to an overflow from the tank. The backside of dike is also leaking brine and crude in small area. Operator needs to clean and properly dispose of the contamination. Operator must also repair the dike in order to prevent leaks of oilfield waste. I talked with Andy and he did not know of the issue and stated the well was shut in. He is going to clean up the mess within the next week, and completely remove the transfer tank battery once there is drier weather.

-1905121104 2013-02-12 Upon inspection, I found an open and corroded valve venting gas from the 4.5" casing. The stuffing box was leaking a considerable amount of material and fluids. There was contamination and pollution in a 6' x 6' area around the wellhead and a trail of contamination ~50 downhill towards a stream. Dead vegetation was visible the entire length. I did not see any signs of contamination in the stream. Straw was thrown down over the area of pollution and contamination around the wellhead. There is a dike located ~ 20' above the wellhead and was full of water. There is a 100 barrel transfer tank. The entire area on the down slope side of the dike was void of vegetation and deep ruts. The dike showed signs of overflow in several places. There was a sheen on the surface of the water in the dike, however I tested the water using the low range Quantab strips and did not show high levels of chlorides (103 ppm). There is a tank battery up on County Road 3, however IDs are not legible. The knockout tank at the battery on the road has overflowed out of dike area and there is some contamination visible on property owners land. Cattle graze in this area. There is a 8' tall/1" steel pipe sticking straight up out of the ground releasing brine. Quantab results were over 6000 ppm at spout. This water drained down slope towards landowner's driveway covering a distance of ~60+ feet. At the driveway drainage ditch Quantab results were ~1800 ppm. This ditch ran down about 60' to a culvert which went under the driveway and opened up into the horse pasture. Quantab results on the pasture-side culvert were around 5000 ppm. I called well tender at 3:30pm and left a message regarding the issues. I then immediately contacted M & R Investments main office and spoke with the secretary. She told me she would relay the message. At 4:30 pm I called well tender, Rusty Hutson, and I explained to him the situation. He was in route to meet with another well tender, Andy, to see what was happening at the location. He said he would call back later this evening. Pictures and video were taken at the locations. M & R Investments needs to repair/replace the valve on the 4.5" casing to prevent gas leak. They also need to clean up and remove all pollution and contamination and restore area in order to maintain vegetative growth. 1360783643 2013-02-13 Compliance Action Follow-UP #-1905121104: Supervisor Dan Goins and myself met with Jody Jasper of Diversified Resources and their well tender. We discussed the various areas on the lease which needed attention and Andy, the well tender, had stated that an excavating crew was already lined up to remove all pollution and contamination tomorrow. He also stated that the 8' pipe sticking out of the ground was a vent pipe for the brine transport line. This line transports brine from the tanks across the road (CR3) to the annular disposal well at the back end of the property (#22999). He will look into the cause of the vent pipe being flooded with brine, but believes landowner had driven over the line with his tractor. He and Jody Jasper were also told to replace the vent pipe with a taller pipe. It was also agreed that the wellhead would be repaired of any gas leaks and the contamination in and around the well location would be removed and restored in order to allow for vegetative growth.
1361466699 2013-02-21 Compliance Action Follow-UP #-1905121104: I was at location with well tender, Andy, and he had removed the vent pipe and hauled off the brine contaminated soil. He was still in the process of fixing and replacing various sections of the plastic lines. He had diapers around the plastic tank in dike which had leaked brine. He is going to have everything cleaned up and the job finished by the end of next week.
1361982785 2013-02-27 Compliance Action Follow-UP #-1905121104: I arrived to inspect the remediation efforts and found site still in need of serious attention. Plastic lines were scattered all around the tank battery and contaminated area. The vent pipe was disconnected and laying on the ground. Line is still being used to transport brine from one area to the annular disposal well. There is a leak at the T-connection down the right hand side of hill from tank battery which is due to bad connection. This was recently worked on but clamps appear to be inefficient. The other leaks in the line still have not been repaired to this day. Diapers and contamination still exist around the small tank adjacent to the dike. There are still no identifications posted on the wellheads or tanks. I called and left a message with the well tender, Andy, but his mailbox was full. I also called and left a message with Jody Jasper explaining the issues. I will return on Monday to follow-up on compliance actions.
1362677952 2013-03-07 Compliance Action Follow-UP #-1905121104: I arrived to find IDs posted on tank but it was unclear which wells were going into tanks. There were no IDs posted at wellheads. The leak in the brine line was repaired however there were two more small leaks further down. Plastic pipes were laying all over the area. The plastic tank by the dike still had diapers down and appeared to have a small leak. I called and talked to Andy and he said he would be out today to correct ids and repair the leaks. He said he would have someone out today or tomorrow to empty the plastic container. Andy also stated that when the weather dries the ground they will remove all of the unnecessary plastic lines and repair the plastic tank. 3/12/2013: Andy called me back today and stated he has someone coming out tomorrow to pick up all of the plastic lines. They are also going to put new fittings in the areas on the line where there were leaks. He said he has had the correct IDs posted on the tanks and has had IDs made for each wellhead. He should be finished with the job by the end of the week. 03/25/2013: I saw Andy and he told me he has scheduled to have backhoe out to move plastic tank into dike area but operator cancelled and is supposed to be out there this week. He said he bought steel line and tubing to run in area where farmer is using farming equipment to cross property. He hopes to have everything complete by end of week. They cleaned up contamination and put peat around tank to absorb any residue.
1363799150 2013-03-20 Compliance Action Follow-UP #-1905121104: I arrived and Andy the well tender was on location. He had IDs in hand and was heading out to individual wells. The pieces of plastic line have been removed from tank battery area and he had laid a new transfer line. He is still having contamination issues with the plastic tank overflowing just outside of the dike. He said he had someone coming out to help him tomorrow with a backhoe to remove the contamination from the plastic tank and believes it is a result from adjacent landowner riding heavy equipment over a line down by the well, which in turn is causing a back up. He is planning on inserting the plastic transfer line into a steel line to avoid compaction. I told him he needs to clean up the contamination immediately and the plastic tank needs to be completely removed or moved inside the dike.
1365694917 2013-04-11 Compliance Action Follow-UP #-1905121104: Andy the well tender stated the area was ready for inspection however when I arrived there still were issues. There were several areas of leaking on brine line running back to transfer tank. The plastic tank up at the road dike was still showing signs of contamiation. They built up a new dike around the plastic tank. The drier weather revealed larger scald area than seen during winter months, which was newly covered with lime and straw. The transfer tank dike still needs some construction work. The side which needs restoration work has only straw scattered around and no signs of seed in order to restore vegetative growth. Some lime and straw was thrown around the wellhead. None of the contamination was actually cleaned up and hauled off location. Operator needs to correct all of these issues.

He has had the dike leveled and will come back in the next few days to seed and straw the entire location. I will return to sign off on the restoration once he has restored vegetative growth.
