•Per the operator’s initial report roughly 10bbl of reuse water was released to the pad surface, the spill was confined to the pad, and did not impact surface waters. -The loss of 10bbl of reuse water to the pad surface does constitute a violation of 58 Pa. C.S. § 3217(a) for Failure to control and dispose of brines produced from the drilling, alteration or operation of a well consistent with the Clean Streams Law and 25 Pa. Code § 78.54 for failure to control brine in a manner that prevents pollution of the waters of the Commonwealth. •The initial report indicates that the spill was caused by overfilling a tank which caused material to be sprayed beyond the secondary containment. •At the time of inspection a large shallow pit partially filled with water was observed in the location of the spill. Water in this excavated area was found to have similar conductivity to standing water elsewhere on the pad not believed to be affected by the spill (between 675-700¿¿s). Living tadpoles were observed in the standing water throughout the site. •No construction or drilling activities were ongoing at the time of inspection. •Stabilizing vegetation immediately adjacent to the first half of the site access road was very sparse in many areas. No violation, remediation recommended. •An area of disturbed ground crossed the site’s access road and led to the pad near the production units. Contact with an operator representative indicated that the disturbance was attributed to a pipeline owned by Superior having been constructed. T |
