Moved onto this well on 1/27/16 and resumed drilling at 40 ft. The 18 5/8” casing was set at 128 ft. on 1/31/16 and cemented to surface with 16 bbls returned. The 13 3/8” casing was set at 247 ft. on 1/31/16. Operator was unable to displace cement to surface and casing was grouted to surface above the basket. Coal was found from 207 ft. to 209 ft. A basket was set at 160 ft. The 9 5/8” casing was set at 1652 ft. on 2/2/16. Operator was unable to displace cement to surface. The SBT log showed cement top at 248 ft. A casing annulus packer was set in the 9 5/8” casing string from 1224 ft. to 1234 ft. (with two 15 ft. pup joints above the packer). TD was at 1698 ft. on 2/2/16.

2487871 Primary Facility 2016-01-08 Routine/Partial Inspection No Violations Noted On 1/8/16, I performed a routine partial inspection at the Bernard Werner Site in response to an operator request to review the site in relation to an upcoming pre-op for a major modification/expansion and made the following observations:

•The site was in generally good condition and no earthwork had begun at the time of inspection. •Three active wells were on the site at the time of inspection, five further wells were permitted for the expanded pad, and one well was proposed but never materialized.

2489202 Primary Facility 2016-01-26 Preoperation Inspection No Violations Noted On 1/26/2016, I performed a preoperation inspection at the Bernard Werner site in response to an operator request and made the following observations:

•Site perimeter controls were in place and functional. •Areas of exposed earth on site that were not being actively worked on were noted to have been temporarily stabilized. •An area near the corner of the impoundment may allow water to leave the LOD. It is recommended that the CFS be extended to meet the nearby culvert. This recommendation was accepted by the operator at the time of inspection and approved as a redline request. No violation. •A roadside ditch sloping towards the pad was not rock lined at the time of inspection, due to directionality being towards site it is being considered an intermediate (not perimeter control). Per the operator it is expected to be finished by the end of the day. No violation. •Multiple redline changes were requested and approved during the inspection including addition of CFS near the entrance and the addition of two

2515184 Primary Facility 2016-05-24 Follow-up Inspection No Violations Noted On 5/24/16, I performed a follow up inspection at the Bernard Werner site monitoring issues noted on 1/26/16 (eFACTS ID: 2489198) and made the following observations:

•A moderately eroded ATV path extends from access road off site, reported to be land owner created. No violation. •The bank of the diversion channel on the up slope side of the access road was largely barren; no prominent erosion damage was noted. The diversion channel was otherwise completed and functional. No violation, remediation recommended. •The cut slope above the well pad was stabilized but was still very sparsely vegetated at the time of inspection. No violation. •The vertical shafts of 8 wells had been drilled on site and were awaiting further drilling at the time of inspection. •Additional bare or sparse patches of vegetation were found on the north side of the site access road near the well pad, one the cut slop between the well pad and the small accessory pad, and between the small pad and the impoundment. •Redline changes app

2627707 Primary Facility 2017-08-22 Routine/Complete Inspection No Violations Noted On 8/22/17 an RTNC inspection of the Bernard Werner well site was conducted. The following was observed:

>>The site appeared stable and in generally good condition.

>>10 wells were observed at the time of inspection.

>>A section of CFS was found near the impoundment in a well vegetated area that should either be maintained or removed.

2666229 Primary Facility 2017-11-28 Incident- Response to Accident or Event No Violations Noted On 11/28/17 an incident inspection of the Werner well site was conducted in response to a spill (CTS ID: 331105) reported on 11/23/17. The following was observed:

>>An area of disturbed earth near a juncture in the site access road was noted to be unstabilized at the time of inspection. No violation, remediation recommended.

>>The exact location of the spill was unable to be determined, operator contacts with detailed information were not available at the time of inspection. No violation, further information needed for determination.

2666557 Primary Facility 2017-12-01 Follow-up Inspection No Violations Noted On 12/1/17 an incident inspection of the Werner well site was conducted in response to a spill (CTS ID: 331105) reported on 11/23/17. The following was observed:

>>The initial report was of a truck rollover that resulted in an estimated spill of 20 gallons of oil to the roadside culvert. The spill was fully cleaned at the time of the initial inspection on 11/28/17 but the location of the spill was unable to be identified. Upon locating the site of the spill cleanup appears to be complete and without further impact. While this constitutes a violation of 25 Pa. Code 78.54 in the the operator failed to control fluids associated with well servicing it has been determined that the violation was immediately corrected.

>>The unstabilized disturbed area noted on 11/28/17 remained unstabilized at the time of inspection. Continued failure to provide temporary stabilization would constitute a violation under 25 Pa. Code 102.22(b)(1).

2667060 Primary Facility 2017-12-04 Follow-up Inspection No Violations Noted On 12/4/17 an FUI inspection was conducted in response to concerns noted during a prior inspection on 12/1/17. The following was noted:

>>The unstabilized area of the site noted during a prior inspection on 12/1/17 had been stabilized at the time of inspection. No violation.

>>A small area between a section of CFS near the road juncture and the drainage channel was not stabilized. CFS at this location was also noted to be damaged. Remediation is recommended, no violation.

2686025 Primary Facility 2018-01-23 Administrative/File Review No Violations Noted On 1/23/18 an administrative inspection related to the Werner Well site was conducted in response to a complaint (CTS ID: 325462). The operator reported the complainant's concerns of potential pollution of a spring used as a partial water supply. Direct contact with the complainant found that the water had a history of methane contamination but no new or ongoing evidence of contamination. Further investigation by the DEP was declined at this time.
2708185 Primary Facility 2018-03-14 Routine/Complete Inspection No Violations Noted Well has been completed and is now producing.
2715890 Primary Facility 2018-04-06 Routine/Partial Inspection No Violations Noted On 4/6/18 a routine partial inspection of the Werner Well Site was conducted in response to an operator request for permit termination review of an adjacent site. The following was observed:

>>An area at the juncture of the access road and the access road of a nearby pipeline site was found to be unstabilized with partially constructed controls and early indications of increased erosion damage. No violation, stabilization in accordance with permit conditions is strongly recommended.

>>The adjacent Werner to Smith Pipeline was reported as unconstructed with regards to the permit termination request. Evidence of pipeline construction within the planned ROW was noted as related to a separate permit.

2725820 Primary Facility 2018-04-27 Follow-up Inspection No Violations Noted On 4/27/18 a follow up inspection of the Werner well site was conducted in response to issues first noted during a 4/6/18 routine partial inspection related to permit termination of an adjacent site. The following was observed:

>>The area noted in inspection report 2715873 as unstabilized and displaying increased erosion remained in much the same condition without surface stabilization. No indication of any work being conducted in the general area during the 21 days between inspections was found. This constitutes a violation of 25 Pa. Code § 102.22(b)(1) in that the operator failed to stabilize an area during any cessation of work in excess of four days.

2815106 Primary Facility 2018-12-13 Compliance Evaluation No Violations Noted On 12/13/18 a compliance evaluation inspection of the Werner Well Site was conducted in response to violations initially noted on 4/27/18. The following was observed:

> The unstabilized area of the site that was the subject of the violations was found to be fully vegetated and stabilized with site BMPs installed. An adjacent area of recent earth work was also stabilized. No further violations were found.
