2082186 2011-07-06 No Violations Noted On July 6, 2012, I stopped at CONSOLï¾’s NV-39 site and checked on the E&S controls while I was there.

The site was well marked and both the E&S plan and the PPC was in a mailbox beside the road.

The access road was clean and well rocked. I did not see excessive drag-out on the main road.

The drainage ditches and the sediment ponds were in reasonable shape.

I noticed gullies starting to form up-slope of the silt sock on the south side. Since these do not breach the controls they are not violations, but there is a chance they could do so in the future.

I do have concerns about the re-vegetation on this site as much of it seems very sparse. I talked to James Black about the situation and I will work with CONSOL to rectify the concerns.

2081936 2012-07-06 No Violations Noted On July 6, 2012, I stopped at CONSOLï¾’s NV-39 site to check on the spring that communicated with the drilling operation. The large, dead oak that was over the spring blew down in the last wind storm and blocks much of the spring. However, the spring itself is running clear. I went down to the UNT and found that it was also clear. I did not see any aquatic life in it but I did see several aquatic insects dancing around it. There were no signs of dead vegetation.

CONSOLï¾’s contractors performed a benthic and chemical analysis of the stream on April 16, 2012 and determine that the stream had returned to pre-release conditions.

Based on my site inspections and the lab work I believe the site is back in compliance.
