| No Violations Noted

| On July 6, 2012, I stopped at CONSOL’s NV-39 site and checked on the E&S controls while I was there.

The site was well marked and both the E&S plan and the PPC was in a mailbox beside the road.

The access road was clean and well rocked.  I did not see excessive drag-out on the main road.

The drainage ditches and the sediment ponds were in reasonable shape.

I noticed gullies starting to form up-slope of the silt sock on the south side.  Since these do not breach the controls they are not violations, but there is a chance they could do so in the future.

I do have concerns about the re-vegetation on this site as much of it seems very sparse.  I talked to James Black about the situation and I will work with CONSOL to rectify the concerns.

| On July 6, 2012, I stopped at CONSOL’s NV-39 site to check on the spring that communicated with the drilling operation.  The large, dead oak that was over the spring blew down in the last wind storm and blocks much of the spring.  However, the spring itself is running clear.  I went down to the UNT and found that it was also clear.  I did not see any aquatic life in it but I did see several aquatic insects dancing around it.  There were no signs of dead vegetation.

CONSOL’s contractors performed a benthic and chemical analysis of the stream on April 16, 2012 and determine that the stream had returned to pre-release conditions.

Based on my site inspections and the lab work I believe the site is back in compliance.

| On August 13, 2018, the Department performed an inspection of the HG Energy, NV39HS well site. Present at time of inspection was Jay Kendra (HG).  The site is located in South Franklin Twp., Washington Co.  The inspection was related to a request by the operator to meet on site to discuss start of construction of the PCSM structures.
 +

 +
The operator plans to begin installation of the PCSM structures on the site and progress towards termination of the ESCGP2 permit.
 +

 +
6 wells have been drilled to completion on the site and are equipped for production.

2063758 Primary Facility 2012-05-01 Drilling/Alteration No Violations Noted
2063759 Primary Facility 2012-04-09 Follow-up Inspection Outstanding Violations - No Viols Req'd CNX is capturing the effluent from the spring and pumping it back into the pad. Testing being done.
2073776 Primary Facility 2012-05-09 Drilling/Alteration No Violations Noted Whipstock 23 is currently drilling @ 4841ft to KOP. Location is in good condition. No problems at time of inspection.
2081324 Primary Facility 2012-05-23 Complaint Inspection No Violations Noted Checked the spring and the stream, both are running clear. The E&S controls are okay but some disturbed areas not greening up as expected.
2081936 Primary Facility 2012-07-06 Compliance Evaluation No Violations Noted On July 6, 2012, I stopped at CONSOL’s NV-39 site to check on the spring that communicated with the drilling operation.
2082186 Primary Facility 2011-07-06 Routine/Complete Inspection No Violations Noted On July 6, 2012, I stopped at CONSOL’s NV-39 site and checked on the E&S controls while I was there.

2766851 Primary Facility 2018-08-13 Routine/Complete Inspection No Violations Noted On August 13, 2018, the Department performed an inspection of the HG Energy, NV39HS well site. Present at time of inspection was Jay Kendra (HG). The site is located in South Franklin Twp., Washington Co. The inspection was related to a request by the operator to meet on site to discuss start of construction of the PCSM structures.

The operator plans to begin installation of the PCSM structures on the site and progress towards termination of the ESCGP2 permit.

6 wells have been drilled to completion on the site and are equipped for production.
